A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
SUPPORTING A PROPOSED AMENDMENT TO SECTION 6152 OF THE
BUSINESS AND PROFESSIONS CODE, WHICH WOULD MAKE IT A
MISDEMEANOR FOR ATTORNEYS TO SOLICIT BUSINESS DIRECTLY
OR THROUGH CAPPERS
WHEREAS, Section 6152 of the State Business and Professions Code provides:
"It is unlawful for any person, in his individual capacity or in

his capacity as a public or private employee, or for any firm,
corporation, partnership or association to act as a runner or
capper for any such attorneys or to solicit any business for any
such attorneys in and about state prisons, county jails, city
jails, city prisons, or other places of detention of persons,
city receiving hospitals, city and county receiving hospitals,
county hospitals, justice courts, municipal courts, superior
courts, or in any public institution or in any public place or
upon any public street or highway or in and about private hospitals,
sanitariums or in and about any private institution or upon private
property of any character whatsoever."
WHEREAS, the Board of Supervisors of Los Angeles County at its meeting of
September 10, 1974 urged that all law enforcement agencies and City Attorneys
within the County join with County authorities in the vigorous investigation
and prosecution of any who violate the hospital patient's right to be protected
from such illegal activities.
NOW, THEREFORE, BE IT RESOLVED:
Section 1. That the City Council of the City of Downey goes on record
in support of the proposed amendment to Section 6152 of the Business and Professions
Code, which would make it a misdemeanor for Attorneys to solicit business directly
or through cappers.
Section 2. The City Clerk shall certify to the adoption of this
Resolution and forward a certified copy to the Los Angeles County Board of
Supervisors.
APPROVED AND ADOPTED this 14th day of October, 1974.
