A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE ANNEXATION OF THE ENTIRE CITY AREA INTO A
CITYWIDE LIGHTING DISTRICT WITH ZONES AS HEREIN DESCRIBED
AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE
STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC
PLACES WITHIN THAT AREA UNTIL JANUARY 31, 1983 PURSUANT
TO THE STREET LIGHTING ACT OF 1919.
-- WHEREAS, the City Council of the City of Downey on July 23, 1974,
adopted Resolution No. 2985, declaring its intention to order certain
improvements; and
WHEREAS, on July 23, 1974, the City Council by Resolution No. 2985
set September 9, 1974 at 7:30 p.m., in the Council Chambers of the City
Hall of the City of Downey, as the time and place for hearing protests
to the proposed improvements; and
WHEREAS, on September 9, 1974, at the time and place specified, a
public hearing was held in accordance with Resolution No. 2985, notice
having been given in the manner required by law; and
WHEREAS, at the hearing the City Council did pass upon all written
and oral protests made in reference to the improvements:
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the public interest and convenience require, that
the City Council of the City of Downey order the annexation of the entire
City area to a Citywide Lighting District having an operation zone (Zone I)
for totally lighted single family residential areas, an operation zone (Zone II)
for totally lighted commercial, industrial, and high density residential areas,
_ an operation zone (Zone III) for areas having intersection lighting only, and
a temporary holding zone (Zone IV) for payment of installation and operation
costs in newly lighted areas with subsequent transferral to Zone I and to
maintain and furnish electrical current to street lighting fixtures located
throughout the City as shown on Plan Nos. SL 20 and SL 100 on file in the office
of the City Clerk, from July 1, 1975 until January 31, 1983, in accordance with
the Report of the Director of Community Development dated July 23, 1974, on
file in the office of the City Clerk and which by this reference is made a part
hereof.
SECTION 2. That this annexation, in the opinion of the City Council, is of
more than ordinary benefit and the Council hereby makes the expense of said
work and improvements chargeable upon the district benefited and to be assessed
to pay the cost and expense thereof. The district shall be the entire area of
the City of Downey with lighted zones as shown on the above specified plans on
file in the office of the City Clerk, on which the boundaries thereof are
described by a boundary line. Reference is hereby made to the plans for a
complete and detailed description of the district. The plans on file shall
govern for all details as to the extent of the assessment district.
SECTION 3. The improvement described in Resolution No. 2985 and the
Report of the Director of Community Development submitted pursuant to Resolution
No. 2983 shall be made in the manner and at the time prescribed by law, and the
levy to be made to raise the estimated cost to be borne by the District shall be
upon all lands and improvements within the District.
SECTION 4. The City Council finds that the Southern California Edison
Company subject to the jurisdiction of the Public Utilities Commission of
the State of California, is the only contractor practically capable of serving
the street lighting improvement in the manner provided for and as described
herein. It is, therefore, ordered that the improvement of the Lighting
District be carried out by the Southern California Edison Company in accordance
with the plans and specifications.
SECTION 5. The Mayor is authorized and directed to execute the contract
with the Southern California Edison Company for the improvements in accordance
with the Report of the Director of Community Development and in accordance with
rates and rules filed by said Company from time to time with the Public
Utilities Commission of the State of California.
SECTION 6. The City Clerk shall certify to the adoption of this
Resolution and cause a certified copy thereof and the map or plan of the
district to be filed with the assessor whose roll is used for the levy and
with the State Board of Equalization and further shall cause a copy of this
resolution to be published once in the Southeast News and Downey Champion.

Resolution.
