HomeMy WebLinkAboutResolution No. 3005 1 RESOLUTION NO. 3005 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CONCURRENTLY WITHDRAWING A PORTION OF THE DOWNEY COUNTY LIGHTING DISTRICT AND ORDERING ANNEXATION OF CERTAIN AREAS TO THE DOWNEY CITY LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THOSE AREAS UNTIL JANUARY 31, 1983 (ANNEXATIONS 74/2 THRU 74/12) WHEREAS, the City Council of the City of Downey on July 23, 1974, adopted Resolution No. 2987, declaring its intention to order certain improvements; and WHEREAS, on July 23, 1974, the City Council by Resolution No. 2987 set August 27, 1974, in the Council Chambers of the City Hall of the City of Downey, as the time and place for hearing protests to the proposed improvements; and WHEREAS, on August 27, 1974, at the time and place specified, a public hearing was held in accordance with Resolution No. 2987, notice having been given in the manner required by law; and WHEREAS, at the hearing the City Council did pass upon all written and oral protests made in reference to the improvements: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The boundaries of these areas to be annexed to the Downey City Lighting District are described on Plan Numbers SL -261, SL- 100/60, SL -263, SL -264, SL -252, SL -235, SL- 100/40 and SL -43 and legal descriptions on file in the office of the City Clerk and by this reference made a part hereof. SECTION 2. Those portions of area number 3, 12150 -56 Orizaba Avenue and area number 4, 12222 Paramount Boulevard, City Fire Station lying within the Downey County Lighting District as described in the report by the Director of Community Development and by legal descriptions on file in the office of the City Clerk, shall be hereby withdrawn from the Downey County Lighting District and concurrently annexed into Zones I and III respectively of the Downey City Lighting District. SECTION 3. The improvement consists of the installation of standards and furnishing of maintenance and energy for street lighting as described in the Report of the Director of Community Development dated July 23, 1974, as approved by the City Council. SECTION 4. The entire estimated cost of the improvement shall be borne by the District, and shall be paid by special assessment taxes levied upon all the lands and improvements within said areas for the period beginning July 1, 1975 and ending January 31, 1983. SECTION 5. The improvement described in Resolution No. 2987 and the Report of the Director of Community Development submitted pursuant to Resolution No. 2986 shall be made in the manner and at the time prescribed by law. SECTION 6. The City Council finds that the Southern California Edison Company subject to the jurisdiction of the Public Utilities Commission of the State of California, is the only contractor practically capable of serving the street lighting improvement in the manner provided for and as described herein. It is, therefore, ordered that the improvement of the Lighting District be carried out by the Southern California Edison Company in accordance with the plans and specifications.
