HomeMy WebLinkAboutResolution No. 2888 RESOLUTION NO. 2888 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY SUBSEQUENT TO THE REQUEST FOR WITHDRAWAL OF THOSE PORTIONS OF COUNTY LIGHTING MAINTENANCE DISTRICT NOS. 1400, 1456, 1565, AND 1741 WHICH ARE INCLUDED WITHIN THE CITY LIMITS OF THE CITY OF DOWNEY ORDERING THE CONCURRENT ANNEXATION OF THOSE AREAS TO THE DOWNEY CITY LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THAT AREA UNTIL JANUARY 31, 1983 (ANNEXATION 73/27) WHEREAS, the City Council of the City of Downey on November 27, 1973, adopted Resolution No. 2877, declaring its intention to order the withdrawal and the concurrent annexation of those portions of County Lighting Maintenance Districts No. 1400, 1456, 1565, and 1741 which are included within the City of Downey; and WHEREAS, on November 27, 1973, the City Council by Resolution No. 2877 set 7:30 p.m., December 10, 1973, in the Council Chambers of the City Hall of the City of Downey, as the time and place for hearing protests to the proposed reorganization; and WHEREAS, on December 10, 1973, the City Council by Resolution No. 2880 requested that the Los Angeles County Road Department withdraw its portions of Lighting Maintenance District Nos. 1400, 1456, 1565, and 1741 from the City of Downey; and WHEREAS, on December 10, 1973, at the time and place specified, a public hearing was held in accordance with Resolution No. 2877, notice having been given in the manner required by law; and WHEREAS, the public hearing was continued to the regular meeting of December 26, 1973; and WHEREAS, at the continued hearing the City Council did pass upon all written and oral protests made in reference to the reorganization: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That those portions of County Lighting Maintenance Districts 1400, 1456, 1565 and 1741 within the City of Downey be annexed to the Downey City Lighting District as shown on Plan Number SL -100 and described by legal descriptions on file in the office of the City Clerk and by this reference made a part hereof. SECTION 2. That this reorganization shall consist of the transfer of administrative authority from the County of Los Angeles to the City of Downey for existing street lighting systems within CLMD Nos. 1400, 1456, 1565 and 1741 as described in the Report of the Director of Community Development dated November 27, 1973, as approved by the City Council. SECTION 3. That the entire operation cost of lights within these areas shall be borne by the Downey City Lighting District, and shall be paid by special assessment taxes levied upon all the lands and improvements within said area for the period beginning July 1, 1974 and ending January 31, 1983. SECTION 4. That the reorganization described in Resolution No. 2877 and the Report of the Director of Community Development submitted pursuant to Resolution No. 2876 shall be made in the manner and at the time prescribed by law, and shall become effective upon the withdrawal of said areas by the County of Los Angeles. SECTION 5. That the City Council finds that the Southern California Edison Company subject to the jurisdiction of the Public Utilities Commission of the State of California, is the only contractor practically capable of serving the street lighting improvement in the manner provided for and as described herein. It is, therefore, ordered that the servicing of the Lighting District be carried out by the Southern California Edison Company. SECTION 6. The Mayor is authorized and directed to execute the contract with the Southern California Edison Company for the improvements in accordance with rates and rules filed by said Company from time to time with the Public Utilities Conuuission of the State of California. SECTION 7. The City Clerk shall certify to the adoption of this Resolution and cause a certified copy thereof and the map or plan of the district to be filed with the assessor whose roll is used for the levy and with the State Board of Equalization and further shall cause a copy of this resolution to be published once in the Southeast News and Downey Champion.
