A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING ITS INTENTION TO REQUEST LOS ANGELES COUNTY
WITHDRAWAL FROM COUNTY LIGHTING MAINTENANCE DISTRICTS
1400, 1456, 1565 AND 1741, AND THE CONCURRENT
ANNEXATION OF THOSE AREAS TO THE DOWNEY CITY LIGHTING
DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT
TO STREET LIGHTING FIXTURES ON THE STREETS AND PUBLIC
PLACES WITHIN THOSE AREAS UNTIL JANUARY 31, 1983.
THE CITY COUNCIL OF THE CITY OF DOWNEY HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the public interest and convenience require, and it
is the intention of the City Council of the City of Downey to order the
withdrawal and the concurrent annexation of certain areas to the Downey
City Lighting District, and to maintain and furnish electrical current to
street lighting fixtures located within Los Angeles County Maintenance
District Numbers 1400, 1456, 1565, and 1741, all as shown on Plan No.
SL -100 on file in the office of the City Clerk, from the date of formation
of the district until January 31, 1983, in accordance with the Report of
the Director of Community Development dated November 27, 1973, on file in the
office of the City Clerk and which by this reference is made a part hereof.
SECTION 2. This annexation, in the opinion of the City Council, is
of more than ordinary benefit and the Council hereby makes the expense of
said work and improvements chargeable upon the district benefitted and to
be assessed to pay the cost and expense thereof. The district is that
portion of the City of Downey shown on the above specified plan on file in
the office of the City Clerk, on which the boundaries thereof are described
by a boundary line. Reference is hereby made to the plan for a complete
and detailed description of the district. The plan on file shall govern
for all details as to the extent of the assessment district.
SECTION 3. Any lots or parcels of land known as public property, as
defined in Section 18014 of the California Streets and Highways Code
( "Street Lighting Act of 1919 "), which are included in the assessment
district shall be exempt from assessment made to cover costs and expenses
of the contemplated improvements.
SECTION 4. The improvements contemplated shall be done under the
provisions of the "Street Lighting Act of 1919 ", Part I of Division 14 of
the California Streets and Highways Code (as amended), under the alternative
procedure for ad valorem assessments provided for in Chapter 8.5 of the
"Street Lighting Act of 1919 ".
SECTION 5. Pursuant to the provisions of Section 18070 of the Streets
and Highways Code, the City Council of the City of Downey hereby sets
December 10, 1973, in the Council Chambers in the City Hall of said City as
the time and place for hearing protests to the proposed reorganization.
SECTION 6. The City Clerk shall give notice of this hearing in the
manner provided in the "Street Lighting Act of 1919 ". The publication of
such notice shall be in the "Southeast News and Downey Champion ", a
newspaper published and circulated in the City and hereby designated by
said City Council for purpose of publication.
SECTION 7. The Director of Public Works of the City of Downey shall
cause to be conspicuously posted along all streets in the district where
the improvement is proposed to be made or which is to be assessed for the
benefits thereof, at not more than 300 feet apart but not less than 3 in
all, notices of the passage of the resolution as required by Section 18071
of the Streets and Highways Code.
SECTION 8. The City Clerk shall certify to the adoption of this
Resolution.
