HomeMy WebLinkAboutResolution No. 2860 RESOLUTION NO. 2860 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN PROPERTY FOR PUBLIC USE LOCATED AT THE NORTH- EAST CORNER OF PARAMOUNT BOULEVARD AND ORANGE STREET (C.C. PROJECT NO. 326) NEW FIRE STATION HEADQUARTERS AND TO RESCIND RESOLUTION NO. 2856 THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council hereby finds, determines and declares that the public interest, convenience, and necessity require the acquisition of land in, on, over, and under the hereinafter described real property for public purposes and all uses appurtenant thereto. That the location of the land for said project has been planned and located in the manner which will be most compatible to the greatest public good and the least private injury. SECTION 2. That the City Council finds, determines, and declares that in order to acquire said land in, on, over, and under said land for said Fire Station purposes and use the name for said purposes, the public interest, convenience, and necessity require the acquisition of the land by the City of Downey in, on, over, and under that certain real property herein- after described, and the City Council hereby declares that it is the intention of the City of Downey to acquire in its name said land in, on, over, and under said hereinafter described real property by condemnation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California authorizing the exercise of the right of eminent domain. SECTION 3. That said real property, the acquisition of which is required by the public interest, convenience, and necessity for the purpose set forth in Sections 1 and 2 hereof, is described as follows: That part of Block "D" of the Rancho Santa Gertrudes, as per map of the Subdivision thereof for the Santa Gertrudes Land Association by Hoffman Brothers, recorded in Book 32 Page 18 of Miscellaneous Records, in the office of the County Recorder of said County, described as follows: Beginning at a point in the west line of said Block "D" distant South 32 20' West 306.30 feet from the northwest corner thereof; thence South 590 06' East 284 feet; thence South 32 20' West 140.80 feet; thence North 59 04' West 284 feet to the Westerly line of said block; thence along said Westerly line North 32 20' East 140.65 feet to the point of beginning. EXCEPT THEREFROM the Southeasterly 82 feet; ALSO EXCEPT that part included in County road along the west side thereof. SECTION 4. That the City Attorney of the City of Downey and the firm of Burke, Williams, and Sorensen hereby are authorized, empowered, and directed to prepare, institute, and prosecute in the name of the City of Downey such proceedings in the proper court having jurisdiction thereof as are necessary for the condemnation of said land in said real property described in Section 3 of this Resolution. SECTION 5. Resolution No. 2856 is hereby rescinded. SECTION 6. The City Clerk shall certify to the adoption of this Resolution.
