A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY ADOPTING AND IMPLEMENTING THE 1973
POLICE MEMORANDUM OF UNDERSTANDING
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE
AS FOLLOWS:
SECTION 1. That the June 8, 1973 Memorandum of Understanding
between the City Manager of the City of Downey and the Downey Police
Officers Association, attached hereto as Exhibit "A" be and the same
hereby is adopted; and the City Manager is directed to revise the appro-
priate provisions of Table I A, Sworn Police Pay Plan on Page 80 of the
City of Downey Personnel Manual, in accordance therewith.
SECTION 2. That Section 5 A on Page 64 of the City of Downey
Personnel Manual relating to sworn Police physical re- examinations
be and the same hereby is amended to read as follows:
A. Sworn Police personnel shall be subject to
physical examinations by City- assigned
physicians at least once every three years
and at such other times as may be directed
by the Chief of Police.
SECTION 3. That Section 8 C on Page 60 of the Personnel Manual
relating to payment of sick leave on death or retirement (last amended
by Resolution 2704) be and the same hereby is amended to read as follows:
C. 1. When a miscellaneous employee has become
entitled to accrued sick leave allowance which
has not been used at the time he dies or retires,
he or his estate shall receive pay for 50% of such
unused sick leave as he is entitled to under sub-
section A of this Section.
2. When a sworn Fire employee has become entitled
to accrued sick leave allowance which has not been
used at the time he dies as a result of a job - incurred
injury or retires, he or his estate shall receive pay
for such 50% unused sick leave, up to a maximum
of 90 days pay for 180 days accumulation, subject
to the following schedule:
Average Annual Sick Percentage for which
Leave Usage Compensation shall be allowed
0 to 5 days 50%
6 to 9 days 37. 5%
10 to 12 days 10%
Provided, in addition, that in the calculation of the
average annual usage of sick leave for sworn Fire
employees, the highest year's usage for those days
of sick leave taken consecutively in such year shall
not be counted in the determination of the average
as indicated above.
3. When a sworn Police employee has become
entitled to accrued sick leave allowance which
has not been used at the time he dies or retires,
he or his estate shall receive pay for such 50%
unused sick leave, up to a maximum of 90 days pay
for 180 days accumulation.
4. A sworn Fire or Police employee who has become
entitled to accrued sick leave allowance which has
not been used after having accumulated 100 days of
sick leave, may convert each two days of accumulated
sick leave above the 100 days, to one day of additional
vacation; provided, however, that not more than ten
such days of additional vacation may be so converted
in any one fiscal year, and that such conversions
shall not be counted in computing "average annual sick
leave usage ", for Fire employees.
SECTION 4. That Section 3 on Page 63 of the Downey City Personnel
Manual relating to dependent medical benefits, be and the same hereby is
amended by deleting the phrase "(sworn Fire and Misc. only) ", following
the qualification date for 100% City payment of dependent medical insurance
of "January 1, 1975 ".
SECTION 5. The City Clerk shall certify to the adoption cf this
Resolution and shall provide for appropriate distribution thereof.

MEMORANDUM QF UNDERSTANDING.
BETWEEN
THE CITY MANAGER OF THE CITY OF DOWNEY
AND THE
DOWNEY POLICE OFFICERS' ASSOCIATION
•
The terns and conditions of employment that are set forth in this
Memorandum have been discussed in good faith between the City Manager
of the City of Downey and the Association, and the City Manager agrees
. to recommend to the Downey City Council that all of the terms and
conditions of employment as set forth herein be incorporated in full
in resolutions of the City Council.

1973 -74
1. 2 -3/4% salary increase for all Association members -
July 1, 1973. (9rJt, 2 )
• 2. 2 -3/4% salary increase for all Association members -
first pay period after November 1, 1973. (Nov. 5, 1973) .
3. 2 -3/4% salary increase for all Association members -
first pay period after March 1, 1974. (March 11, 1974) .
4. Association members agree to waive six (6) accrued days of
compensatory or holiday time per man. (48 hours).
5. Association members shall take physical examinations at
such times as may be required but at least once every three
years, providing that the current City Pre -Paid Medical
Plan remains in effect. (30 and over)
1974 -75
1. 2 -3/4% salary increase for all Association members -
- July 1, 1974. z

2. 2 -3/4% salary increase for all Association members
• first pay period after December 1, 1974. (Dec. 2, 1974).
3. 2% at 50 retirement program will be adopted to be effective
January 1, 1975.
• 4. City will pay 100% dependents medical insurance coverage
• effective January 1, 1975.
5. Association members agree to waive four (4) days accrued
time. (32 hours).

MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY MANAGER OF THE CITY OF
DOWNEY AND THE DOWNEY POLICE OFFICERS' ASSOCIATION
•
6. Association members agree to a modified sick leave plan. A
maximum of ninety (90) days that will be paid upon death or
retirement. (i.e., ninety (90) days maximum would be reached
after accumulating one hundred eighty (180) days).
A. Sick leave conversion to vacation on the basis of one (1)
vacation day for two (2) days of accumulated sick time.
'This after accumulation of one hundred (100) days of sick
leave. 0=
7. Provision that if cost of living during the term of this
agreement exceeds 150% of salary increase contained therein
s" (81/4% first year; 51% second year) then salary provisions of
this agreement may be re- opened.
THIS AGREEMENT DOES NOT INCLUDE THE RANKS OF CAPTAIN OR CHIEF.
(WITH THE EXCEPTION OF THE 2% AT 50 RETIREMENT PROGRAM)
