HomeMy WebLinkAboutResolution No. 2777 RESOLUTION NO. 2777 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN PROPERTY FOR STREET PURPOSES ON THE WESTERLY SIDE OF BROOKSHIRE AVENUE, NORTH OF FLORENCE AVENUE. (S. S. Project No. 269) THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council hereby finds, determines and declares that the public interest, convenience and necessity require the acquisition of right -of -way in, on over and under the hereinafter described real property for public street purposes and all uses appurtenant thereto. That the location of the land for said street has been planned and located in the manner which will be most compatible to the greatest public good and the least private injury. SECTION 2. That the City Council finds, determines and declares that, in order to acquire said right -of -way in, on, over and under said land for said street purposes and use the same for said purposes, the public interest, convenience and necessity require the acquisition of the right -of -way by the City of Downey in, on, over and under that certain real property hereinafter described, and the City Council hereby declares that it is the intention of the City of Downey to acquire in its name said right -of -way, in, on, over and under said hereinafter described real property by condemnation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California authorizing the exercise of the right of eminent domain. SECTION 3. That said real property, the acquisition of which is required by the public interest, convenience and necessity for the purpose set forth in Sections 1 and 2 hereof, is described as follows: Parcel 1. 8460 Otto Street. The easterly 32.00 feet of that portion of the Rancho Santa Gertrudes, in the City of Downey, County of Los Angeles, State of California, as shown on Map recorded in Book 1, Page 156, of Patents, in the Office of the County Recorder of said County, described as follows: Beginning at the Northeasterly terminus of a course of South 31 ° 10'20" West 105.55 feet in the centerline of Downey Avenue (formerly Crawford Street) as shown on Map of Tract No. 6155, recorded in Book 108, Pages 6 and 7 of Maps, in the Office of the said County Recorder, and being the point of beginning, in Deed recorded in Book 17593, Page 286, Official Records, in the Office of the said County Recorder; thence along the centerline of Florence Avenue, as described in said Deed, South 64 East 461.72 feet; thence North 31 ° 12'20" East 852.47 feet; thence South 58 ° 44'10" East 407.80 feet; thence South 31 ° 11'30" West 264.99 feet to the true point of beginning; thence South 31 ° 11'30" West 144.06 feet; thence South 58 ° 44'10" East 440.90 feet, more or less, to the centerline of Lexington and Gallatin Road, as shown on County Surveyor's Nap No. 7676 on file in the Office of the County Surveyor of said County; thence along said centerline, North 31 ° 52'30" East 144.09 feet to a line that bears South 58 ° 44'10" East from the true point of beginning; thence thereon North 58 ° 44'10" West 442.63 feet, more or less, to the true point of beginning. EXCEPT THE Northeasterly 15 feet thereof. ALSO EXCEPT THE Northwesterly 340.00 feet thereof. ALSO EXCEPT THE portion previously dedicated for Road Purposes. Resolution No. 2777 Page 2 Parcel 2. 8460 Otto Street. The Easterly 40.00 feet of that portion of the Rancho Santa Gertrudes, in the City of Downey, County of Los Angeles, State of California, as shown on Map recorded in Book 1, Page 156, of Patents, in the Office of the County Recorder of said County, described as follows: Beginning at the Northeasterly terminus of a course of South 31 ° 10'20" West 105.55 feet in the centerline of Downey Avenue (formerly Crawford Street) as shown on Map of Tract No. 6155, recorded in Book 108, Pages 6 and 7 of Maps, in the Office of the said County Recorder, and being the point of beginning, in Deed recorded in Book 17593, Page 286, Official Records, in the Office of the said County Recorder; thence along the centerline of Florence Avenue, as described in said Deed, South 64 ° 26'00" East 461.72 feet; thence North 31 ° 12'20" East 852.47 feet; thence South 58 ° 44'10" East 407.80 feet; thence South 31 ° 11'30" West 264.99 feet to the true point of beginning; thence South 31 ° 11'30" West 144.06 feet; thence South 58 ° 44'10" East 440.90 feet, more or less, to the centerline of Lexington and Gallatin Road, as shown on County Surveyor's Map No. 7676 on file in the Office of the County Surveyor of said County; thence along said centerline, North 31 ° 52'30" East 144.09 feet to a line that bears South 58 ° 44'10" East from the true point of beginning; thence thereon North 58 ° 44'10" West 442.63 feet, more or less, to the true point of beginning. EXCEPT THE Northeasterly 15 feet thereof. ALSO EXCEPT THE Northwesterly 340.00 feet thereof. ALSO EXCEPT THE portion previously dedicated for Road Purposes. SECTION 4. That the City Attorney of the City of Downey and the firm of Burke, Williams and Sorensen hereby are authorized, empowered and directed to prepare, institute and prosecute in the name of the City of Downey, such proceedings in the proper court having jurisdiction thereof as are necessary for the condemnation of said right -of -way in said real property described in Section 3 of this Resolution. Said Attorneys are hereby authorized and empowered to take such procedure as may be necessary to secure an order of Immediate Possession for the use and occupancy of said property. SECTION 5. The City Clerk shall certify to the adoption of this Resolut ion.
