A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ESTABLISHING RULES AND PROCEDURES RELATIVE TO WATER
SERVICE DEPOSIT REFUNDS
WHEREAS, the Downey Municipal Code, Section 7319, authorizes the City
Council to adopt rules and procedures over the return of certain deposit
_ fees previously paid by a new service user to water service by the City;
and
WHEREAS, it appears that the practice of requiring a permanent deposit
is not in the interest of sound service relations nor necessary to assure
payment for service rendered.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. The "new service fee" required pursuant to Section 7319 of
the Downey Municipal Code shall be returned to the depositor where water
service has been rendered thereto for a period of twelve months.
SECTION 2. All refunds allowed by Section 1 shall be made on a
regular basis under procedures established by the Director of Finance and
approved by the City Manager.
SECTION 3. The Director of Finance, upon advice of the Water Superin-
tendent, may require retention of said deposit where the account of the
service user has been unreasonably delinquent.
SECTION 4. The City Clerk shall certify to the adoption of this
Resolution.
