HomeMy WebLinkAboutResolution No. 2740 RESOLUTION NO. 2740 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY PROTESTING THE ERECTION OF MASSIVE 100 FOOT STEEL TRANSMISSION TOWERS ON RESIDENTIAL STREETS AND OBJECTING TO THE OPINION OF THE PUBLIC UTILITIES COMMISSION THAT RESIDENTIAL STREETS ARE APPROPRIATE LOCATIONS THEREFOR WHEREAS, certain public utility companies have erected massive one hundred foot steel towers along primarily single family residential streets, which towers will transmit 220,000 volts of electricity; and WHEREAS, such towers and wires are so high, massive, unsightly and aesthetically incompatible with their surroundings so as to be repulsive to the sensibilities and senses of proportions of reasonable men; and WHEREAS, public utilities in the State of California contend that said towers may be constructed in franchise locations without a penny of compensa- tion being paid to affected homeowners, which contention has been agreed with by the Public Utilities Commission; and WHEREAS, the Superior Court of the County of Los Angeles has previously issued a temporary restraining order and preliminary injunction barring further construction of said poles and wires in the City of Torrance, which action was prosecuted by the City of Torrance, the City of Inglewood and the Attorney General of the State of California; and WHEREAS, despite said action of the Superior Court, the State Public Utilities Commission has found that primarily single family residential areas are appropriate locations for such massive and unsightly facilities, which opinion is contrary to the recommendation of its own staff and to the opinion of every environmental expert who testified before the Public Utilities Commission on this matter; and WHEREAS, if the Public Utilities Commission opinion regarding primarily single family residential areas is allowed to stand, there is nothing to pre- vent a utility from erecting similar massive and aesthetically incompatible towers upon any street in any other city in the State of California. NOW, THEREFORE, BE IT RESOLVED, THAT THE CITY COUNCIL OF THE CITY OF DOWNEY HEREBY PROTESTS the lack of concern for the public, evidenced by the Public Utilities Commission in its opinion that primarily single family residential areas are appropriate locations for the construction of one hundred foot steel towers and attendant 220,000 volt transmission lines, which facilities, wherever possible, should be undergrounded or placed in a utility's fee owned right of way. BE IT FURTHER RESOLVED THAT THE CITY COUNCIL OF THE CITY OF DOWNEY HEREBY RECOMMENDS that legislation that would return to the cities of California con- trol over the placement of utility facilities on public property within their jurisdictions be prepared and submitted by the Legislature of the State of California. The City Clerk shall certify to the adoption of this Resolution. APPROVED AND ADOPTED this 13th day of November, 1972.
