HomeMy WebLinkAboutResolution No. 2711 RESOLUTION NO. 2711 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING JAIL INMATE WORK POLICY WHEREAS, the California Penal Code Section 4017 provides that a City may adopt an appropriate order requiring City prisoners to perform labor on public works incident to their incarceration, AND WHEREAS, it is apparent that should a City elect not to enact such order said prisoners, if injured while performing labor for the respective City, may be deemed an employee and eligible for Workmen's Compensation benefits, AND WHEREAS, it is intended that said prisoners so in custody be excluded from coverage under Workmen's Compensation laws, thereby precluding added cost to the City, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. All persons confined in the City jail or other detention facility through contract under a final judgment of imprisonment rendered in a criminal action or proceeding and all persons confined in the City jail or other detention facility through contract as a condition of probation after suspension of imposition of a sentence or suspension of execution of sentence shall be required to perform labor on public works of the City incident to their incarceration as the Chief of Police may direct. Such work shall be of a reasonable nature as allowed by applicable law. SECTION 2. All unsentenced prisoners in the custody of the Police Department, while detained within the holding facility or other facility through contract, shall not be required to work for the City, nor shall — said prisoners be requested to work voluntarily. SECTION 3. Appropriate administrative action shall be effected to implement this Resolution. SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
