HomeMy WebLinkAboutResolution No. 2704 RESOLUTION NO. 2704 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY EFFECTUATING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY MANAGER AND THE DOWNEY FIREMEN'S ASSOCIATION DATED JULY 5, 1972 WHEREAS, in accordance with the Employee Relations Ordinance ( #394) the City Manager and the Downey Firemen's Association have sub- - mitted a Memorandum of Understanding for the determination of the City Council. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That Table I (Plan of Salary Schedules) on pages 78 -79 of the Downey City Personnel Manual relating to sworn classified employees of the City be and the same is hereby amended by increasing each of the rates shown therein according to the following shcedule for the members of the sworn Fire service only: Percentage of Increase Effective Date 2.75% July 1, 1972 2. 75% The last 19 pay periods of 1972 -73 2. 75% July 1, 1973 2. 75% July 1, 1974 2. 75% The last 6 pay periods of 1974 -75 2. 75% July 1, 1975 2. 75% The last 6 pay periods of 1975 -76 SECTION 2. That Section 3A (1) (Eligibility for Salary Step Increase) on page 77 of the Downey City Personnel Manual as amended by Resolution 2697 effective July 1, 1972, be and the same is hereby amended to read as follows: Non -sworn and Fire Classified Employees Step A Hiring Step Step B After 6 months of service Step C After 18 months of service Step D After 30 months of service Step E After 42 months of service Sworn Police Classified Employees Step A Hiring Step Step B After 6 months of service Step C After one year of service Step D After two years of service Step E After three years of service SECTION 4. 2% at 50 Benefit. That at the appropriate time so that the benefits would be effective as of January 1, 1974, the City Manager is authorized to initiate the procedure for securing such benefits as of such date for sworn Fire employees upon the condition that such benefits are available in accordance with the Public Employees' Retirement System law as of that date. SECTION 5. That a new section, C -1, be added to Section 5C, Holidays, on page 58 of the Downey City Personnel Manual, to read as follows: Section 0.1. Sworn Fire personnel shall not be compensated for the first three holidays of 1973 nor for the first six holidays of 1974..75 and 1975 -76. This section shall stand repealed on July 1, 1976. SECTION 6. That Section B (Eligibility for Merit Longevity) on page 85 of the Downey City Personnel Manual be and the same is hereby amended to read as follows: B. Eligibility for Merit Longevity. Upon approval of the appointing power, permanent miscellaneous and sworn Police employees who have completed ten continuous years of satisfactory service may be paid, in addition to their respectively regular prescribed salary, a monthly amount equal to the next salary step above their monthly base salary, and after 20 years, an additional one and one -half step above their monthly base salary. For sworn Fire employees, longevity shall be paid under requirements set forth herein at the rate of one salary step above the E after satisfactory completion of ten years of service. No sworn Fire employee shall be eligible for this payment who shall have been hired after July 1, 1974. SECTION 7. That Section 3 on page 63 of the Downey City Personnel Manual as amended by Resolution 2697 effective July 1, 1972, is hereby amended to read as follows: "When any dependent of any permanent miscellaneous or sworn Police employee is enrolled in a medical plan approved by the City, the City shall contribute the following percentage of the dependent's medical plan, which shall be paid for by the City to the medical group or company designated by the City: Percentage of City Contribution Effective Date 50% January 1, 1972 (now in effect) 75% January 1, 1973 (Miscellaneous only) 100% January 1, 1974 (Miscellaneous only) When any dependent of any permanent sworn Fire employee is enrolled in a medical plan approved by the City, the City shall contribute the total sum of the dependent's medical premium which shall be paid by the City to the medical group or company designated by the City, as follows: Percentage of City Contribution Effective Date 50% January 1, 1972 (now in effect) 100% January 1, 1975 SECTION 8. That Section C on page 60 of the Downey City Personnel Manual relating to reimbursement for unused sick leave be and the same is hereby amended to read as follows: "When a sworn Fire employee who has become entitled j to accrued sick leave allowance which has not been used at the time he dies as a result of a job - incurred injury or retires, he or his estate shall receive pay for such 50% unused sick leave, up to a maximum of 90 days pay for 180 days accumulation. Average Annual Percentage for which Sick Leave Usage Compensation shall be allowed I 0 to 5 days 50% 6to9days 37.5% 10 to 12 days 10% Provided, however, that in the calculation of the average annual usage of sick leave, the highest year's usage for those days of sick leave taken consecutively in such year shall not be counted in the determination of the average as indicated above. A sworn Fire employee who has become entitled to accrued sick leave allowance which has not been used after having accumulated 100 days of sick leave, may convert each two days of accumulated sick leave above the 100 days, to one day of additional vacation; provided, however, that not more than ten such days of additional vacation may be so converted in any one fiscal year, and that such conversions shall not be counted in computing 'average annual sick leave usage'. When a miscellaneous or sworn Police employee, who has become entitled to accrued sick leave allowance which has not been used at the time he dies or retires, he or his estate shall receive pay for 50% of such unused sick leave as he is entitled to under sub - section A of this Section." After,meeting and conferring in good faith, the City Manager and the Do-, ney Firemen's Association agree on the following recorn. mendations to the City Council for 1972.73. A four year program is outlined in order to accommodate - __ the high cost of the C.H. P. Retirement Plan. • In the event the cost of living increases more than 150 of the 4.4% average annual salary increase in a given fiscal year, the 'Associa- tion would be allowed to reopen negotiations with respect to salary items only. In the event the State mandates the C.H. P. Plan prior to . the effective date of item 4,(January 1, 1974), the parties would agree to reopen negotiations on this agreement and revert to present plan, in regard to items number 7, 8, and 1 la. Thompson, City Manager • SUBJECT: July 13, 1972 Offer PROPOSED AGREEMENT FOR 1972 -73 1 After meeting and conferring in good faith, the City Manager and the Downey Police Officers Association agree on the following recornmenda•• • tions to the City Council for 1972..73, 1. A one step salary increase for all Association members effective July 1, 1972. 2, City payment of 75% of dependent medical coverage effective April 1, 1973. 3. An increase in the eligible period from B to C step to one year from the present six months. This would provide a 32 year period for employees to reach the E step for anyone hired after July I, 1972, • 4. An increase in the uniform allowance to $125.00 per year for uniformed members. Supervisor shall permit maximum discretion to the officer in the selection of items of, uniforms, provided however that any•officer shall meet uniform standards within ten (10) working days after notice , after which the cost of such needed uniform shall be deducted from l saary.
