A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
URGING A CHANGE IN POLICY WHEREBY FEDERAL AGENCIES WILL
NOT PRE':EMPT HOME RULE THROUGH PROCEDURES WHICH CONFLICT
WITH STANDARDS ADOPTED BY LOCAL GOVERNMENT.
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
WHEREAS, cities or counties requiring federal financing or approval
in conjunction with housing and urban development are being required by
the federal government to permit the use of building materials not per-
mitted by those jurisdictions,
WHEREAS, existing and new buildings in cities or counties are being
required to retroactively conform to code standards that are in conflict
with the requirements in those jurisdictions,
WHEREAS, these procedures used by the federal government are based
upon the invalid conclusions that costs to the building owners will be
reduced materially, that safety to the life of the building occupant
will not be jeopardized and that the code standards used by the great
majority of American cities are not equivalent to the standards ar-
bitrarily adoped by the federal government,
WHEREAS, the determination of the needs of a community has tra-
ditionally been the prerogative of the American consumer and his only
effective representative, the local government,
NOW, THEREFORE, BE IT RESOLVED, THAT THE CITY OF DOWNEY urges its
legislative representative to take whatever steps are necessary to
effect a change in policy whereby federal agencies will not pre -empt
home rule through procedures such as the withholding of federal funds
or the federal adoption and enforcement of standards which conflict
with the nationally recognized standards adopted by the local govern-
ment.
ThE CITY CLERK SHALL CERTIFY TO THE ADOPTION OF THIS RESOLUTION.
APPROVED AND ADOPTED this 12th day of June, 1972.

held on the 12th day of June, 1972, by the following vote, to wit:
