A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING ANNEXATION OF CERTAIN AREAS TO THE DOWNEY CITY
LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL
'— CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON
STREETS AND PUBLIC PLACES WITHIN THE AREAS UNTIL
JANUARY 31, 1983 (ANNEXATION 72/1 THROUGH 72/11)
WHEREAS, the City Council of the City of Downey on April 25, 1972,
adopted Resolution No. 2679, declaring its intention to order certain
improvements; and
WHEREAS, on April 25, 1972, the City Council by Resolution No. 2679
set 8:00 a.m. on May 23, 1972, in the Council Chambers of the City Hall
of the City of Downey, as the time and place for hearing protests to
the proposed improvements; and
WHEREAS, on May 23, 1972, at the time and place specified, a public
hearing was held in accordance with Resolution No. 2679, notice having
been given in the manner required by law; and
WHEREAS, at the hearing the City Council did pass upon all written
and oral protests made in reference to the improvements:
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE
AS FOLLOWS:
SECTION 1. The boundaries of the areas to be annexed to the Downey
City Lighting District are described on Plans Numbers SL -177, SL -179, SL -196,
SL -213, SL -214, SL -215, SL -217, SL -218, SL -219, SL -222 and SL -223, and legal
descriptions on file in the office of the City Clerk and by this reference
made a part hereof.
SECTION 2. The improvements consist of the installation of standards
and furnishing of maintenance and energy for street lighting as described
in the Report of the Director of Public Works dated April 25, 1972, as
approved by the City Council.
SECTION 3. The entire estimated cost of the improvements shall be borne
by the District, and shall be paid by special assessment taxes levied upon
all the lands and improvements within said areas for the period beginning
July 1, 1973, and ending January 31, 1983.
SECTION 4. The improvements described in Resolution No. 2679 and the
Report of the Director of Public Works submitted pursuant to Resolution
No. 2678 shall be made in the manner and at the time prescribed by law.
SECTION 5. The City Council finds that the Southern California Edison
Company subject to the jurisdiction of the Public Utilities Commission of
the State of California, is the only contractor practically capable of serving
the street lighting improvements in the manner provided for and as described
herein. It is, therefore, ordered that the improvements of the Lighting
District be carried out by the Southern California Edison Company in
accordance with the plans and specifications.
SECTION 6. The Mayor is authorized and directed to execute the
contract with the Southern California Edison Company for the improvements
in accordance with the plans and specifications and in accordance with
rates and rules filed by said Company from time to time with the Public
Utilities Commission of the State of California.
SECTION 7. The City Clerk shall certify to the adoption of this
Resolution and cause a certified copy thereof and the maps or plans of the
districts to be filed with the assessor whose roll is used for the levy
and with the State Board of Equalization and further shall cause a copy
of this resolution to be published once in the Southeast News and Downey
Champion.
