HomeMy WebLinkAboutResolution No. 2625 RESOLUTION NO. 2625 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING THAT AN UNDERGROUND UTILITY DISTRICT IS FORMED PURSUANT TO RESOLUTION NO. 2619, (DISTRICT NO. 5) WHEREAS, pursuant to Resolution No. 2619 a public hearing was held on December 13, 1971, by the City Council of the City of Downey; and WHEREAS, notice of such hearing was given in the manner required by law; and WHEREAS, such hearing duly has been held and all persons interested were given an opportunity to be heard. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That it hereby finds and determines that the public necessity, health, safety and welfare require the removal of poles, over- head wires and associated structures and the underground installation of wires and facilities for supplying electrical, communications or similar or associated service in the City of Downey along Imperial Highway, a major arterial highway extensively used by the general public and carrying a heavy volume of vehicular traffic, between Old River School Road and Rives Avenue as shown on Plan No. 2 -18 -384. The boundary of Underground Utility District No. 5 is further described in detail by a legal description which is filed in the office of the City Clerk along with Plan No. 2 -18 -384 which by this reference is made a part hereof. SECTION 2. Those poles, overhead wires and associated overhead structures along Imperial Highway between Old River School Road and Rives Avenue as shown on Plan No. 2 -18 -384 shall be removed and underground in- stallationsmade in said Underground Utility District within the following periods: Underground installation by utility companies and property owners and reconnections not later than June 30, 1972, provided, however, utility companies upon a showing that they cannot comply with such limitations may, upon approval of the City Council, have an exten- sion of time not to exceed 120 days. SECTION 3. The City shall within ten (10) days after the adoption of this Resolution mail a copy of the same and a copy of Article VII, Chapter 5, of the Downey Municipal Code to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
