HomeMy WebLinkAboutResolution No. 2622 RESOLUTION NO. 2622 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING ANNEXATION OF A CERTAIN AREA TO THE DOWNEY CITY LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THAT AREA UNTIL JANUARY 31, 1983 (ANNEXATION 71 AREA 29) WHEREAS, the City Council of the City of Downey on November 8, 1971, adopted Resolution No. 2605, declaring its intention to order certain improvements; and WHEREAS, on November 8, 1971, the City Council by Resolution No. 2605 set 7:30 p.m., December 13, 1971, in the Council Chambers of the City Hall of the City of Downey, as the time and place for hearing protests to the proposed improvements; and WHEREAS, on December 13, 1971, at the time and place specified, a public hearing was held in accordance with Resolution No. 2605, notice having been given in the manner required by law; and WHEREAS, at the hearing the City Council did pass upon all written and oral protests made in reference to the improvements: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The boundaries of that area to be annexed to the Downey City Lighting District are described on Plan Number SL -205 and legal description on file in the office of the City Clerk and by this reference made a part hereof. SECTION 2. The improvement consists of the installation of standards and furnishing of maintenance and energy for street lighting as described in the Report of the Director of Public Works dated November 8, 1971, as approved by the City Council. SECTION 3. The entire estimated cost of the improvement shall be borne by the District, and shall be paid by special assessment taxes levied upon all the lands and improvements within said area for the period beginning July 1, 1972, and ending January 31, 1983. SECTION 4. The improvement described in Resolution of Intention No. 2605 and the Report of the Director of Public Works submitted pursuant to Resolution No. 2604 shall be made in the manner and at the time prescribed by law. SECTION 5. The City Council finds that the Southern California Edison Company subject to the jurisdiction of the Public Utilities Commission of the State of California, is the only contractor practically capable of serving the street lighting improvement in the manner provided for and as described herein. It is, therefore, ordered that the improvement of the Lighting District be carried out by the Southern California Edison Company in accordance with the plans and specifications. SECTION 6. The Mayor is authorized and directed to execute the contract with the Southern California Edison Company for the improvements in accordance with the plans and specifications and in accordance with rates and rules filed by said Company from time to time with the Public Utilities Commission of the State of California. SECTION 7. The City Clerk shall certify to the adoption of this Resolution and cause a certified copy thereof and the map or plan of the district to be filed with the assessor whose roll is used for the levy and with the State Board of Equalization and further shall cause a copy of this resolution to be published once in the Southeast News and Downey Champion.
