RESOLUTION NO. 2593
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING ANNEXATION OF CERTAIN AREAS TO THE DOWNEY CITY
LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL
CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON
STREETS AND PUBLIC PLACES WITHIN THAT AREA UNTIL
JANUARY 31, 1983 (ANNEXATION 71/14 THROUGH 71/27)
WHEREAS, the City Council of the City of Downey on August 24, 1971,
adopted Resolution No. 2578, declaring its intention to order certain
improvements; and
WHEREAS, on August 24, 1971, the City Council by Resolution No. 2578
set 8:00 o'clock A.M., September 28, 1971, in the Council Chambers of the
City Hall of the City of Downey, as the time and place for hearing
protests to the proposed improvements; and
WHEREAS, on September 28, 1971, at the time and place specified,
a public hearing was held in accordance with Resolution No. 2578, notice
having been given in the manner required by law, and
WHEREAS, at the hearing the City Council did pass upon all written
and oral protests made in reference to the improvements:
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE
AS FOLLOWS:
SECTION 1. The boundaries of that area to be annexed to the Downey
City Lighting District are described on Plans Numbers SL -179, SL -183,
SL -184, SL -185, SL -186, SL -169, SL -187, SL -192, SL -196, SL -198, SL -194,
and SL -195 and legal descriptions on file in the office of the City Clerk
and by this reference made a part hereof. That portion of Annexation 71/17
within the Downey County Lighting District shall be concurrently dissolved
from the Downey County Lighting District and annexed to the Downey City
Lighting District.
SECTION 2. The improvement consists of the installation of standards
and furnishing of maintenance and energy for street lighting as described
in the Report of the Director of Public Works dated August 24, 1971, as
approved by the City Council.
SECTION 3. The entire estimated cost of the improvement shall be
borne by the District, and shall be paid by special assessment taxes levied
upon all the lands and improvements within said area for the period beginning
July 1, 1972, and ending January 31, 1983.
SECTION 4. The improvement described in Resolution No. 2577 and the
Report of the Director of Public Works submitted pursuant to Resolution
No. 2578 shall be made in the manner and at the time prescribed by law.
SECTION 5. The City Council finds that the Southern California Edison
Company subject to the jurisdiction of the Public Utilities Commission of
the State of California, is the only contractor practically capable of
serving the street lighting improvement in the manner provided for and as
described herein. It is, therefore, ordered that the improvement of the
Lighting District be carried out by the Southern California Edison Company
in accordance with the plans and specifications.
Section 6. The Mayor is authorized and directed to execute the
contract with the Southern California Edison Company for the improvements
in accordance with the plans and specifications and in accordance with
rates and rules filed by said Company from time to time with the Public
Utilities Commission of the State of California.
Section 7. The City Clerk shall certify to the adoption of this
Resolution and cause a certified copy thereof and the map or plan of the
district to be filed with the assessor whose roll is used for the levy
and with the State Board of Equalization and further shall cause a copy
of this resolution to be published once in the Southeast News and Downey
Champion.
