HomeMy WebLinkAboutResolution No. 2586 RESOLUTION NO. 2586 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING THE VACATION OF HORTON LANE LYING SOUTHERLY OF IMPERIAL HIGHWAY IN THE RANCHO LOS AMIGOS COUNTY HOSPITAL PROPERTY. WHEREAS, by Resolution Number 2573 adopted on the 9th day of August 1971, the City Council of the City of Downey declared its intention to vacate Horton Lane lying southerly of Imperial Highway as shown on map on file in the office of the City Clerk, to which reference is made for further particulars; and WHEREAS, the public hearing on said vacation was held and a full and fair hearing was had thereon: NOW, THEREFORE, the City Council of the City of Downey does resolve as follows: SECTION 1. The City Council of the City of Downey finds from the evidence submitted at said hearing that this area proposed for vacation is not necessary for present or prospective street purposes and is therefore ordered vacated; said area to be vacated is described as follows: That portion of Horton Lane formerly Horton Drive, in Lot C, Rancho Santa Gertrudes subdivided for the Santa Gertrudes Land Association, in the City of Downey, County of Los Angeles, State of California, as shown on map recorded in Book 1, page 502, of Miscellaneous Records, in the office of the Recorder of said County, declared a public highway by order of the Board of Supervisors of said County, as noted in Road Book 14, page 117, on file in the office of said Board of Supervisors, said portion lies southwesterly of the southwesterly boundary of that certain 100 foot strip of land described in Parcel A of deed to City of Downey, for Imperial Highway, recorded as Document No. 2767, on August 6, 1958, in Book D178, page 623, of Official Records, in the office of said Recorder. SECTION 2. Pursuant to the authority of Section 8330 and 8331 of the Streets and Highways Code of the State of California, the City Council hereby determines that the public convenience and necessity require the reservations of a permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers, and appurtenant structures in, upon, over and across the street or part thereof, proposed to be vacated, and maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures and fixtures for the operation of gas pipe lines, telegraph and telephone lines, and for the transportation and distribution of electrical energy, water, and incidental purposes, including access and the right to keep the property free from flammable materials and weed growth, and otherwise protect the same from all hazards, in, upon, and over that portion of the street proposed to be vacated as described above in Section 1. All proceedings for the vaction of said street are taken and shall be subject to the reservation of said described easement. SECTION 3. The City Clerk shall certify to the adoption of this Resolution and cause a certified copy thereof attested by the City Clerk under the seal of the City of Downey to be recorded in the office of the County Recorder of the County of Los Angeles.
