A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
REQUESTING THE BOARD OF ADMINISTRATION OF THE PUBLIC
EMPLOYEES' RETIREMENT SYSTEM TO GRANT A ONE -YEAR
DEFERMENT OF CURRENT RETIREMENT RATE AND APPROVING AN
AMENDMENT TO THE CONTRACT BETWEEN THE BOARD OF
ADMINISTRATION OF THE PUBLIC EMPLOYEES' RETIREMENT
SYSTEM AND THE CITY OF DOWNEY TO EFFECT SUCH DEFERMENT
WHEREAS, Senate Bill 249 (Grunsky, et al) which established a current
retirement rate for employer at 7.15% effective July 1971, was amended on
June 4, 1971 to provide for relief for those contracting agencies whose
current rate is below the applicable S. B. 249 rate, which relief is a
provision for deferment of the established current rate for a period of
one year, July 1, 1971 through June 30, 1972, said deferment to become a
liability to be funded over a period of years not to exceed 29 years; and
WHEREAS, said deferment may be obtained by submitting to the Board of
Administration of the Public Employees' Retirement System an appropriate
resolution adopted by the governing body immediately upon enactment of
S. B. 249, as amended, and prior to July 1, 1971; and
WHEREAS, the deferment provided by the amendment to S. B. 249 would
effect the following Amendment to Contract between the Board of
Administration, Public Employees' Retirement System and the City Council
of the City of Downey:
"Paragraph 7 (a) shall be stricken from said contract
and the following substituted therefor:
7 (a) With respect to miscellaneous members, the public
agency shall contribute the following percentages
of monthly salaries earned as miscellaneous
members of said System:
(1) 0.050 percent until June 30, 2000 on account
of the liability of prior service benefits.
(2) 4.229 percent on account of the liability
for current service benefits through June 30,
1972."
NOW, THEREFORE, BE IT RESOLVED, that the City Manager of the City of
Downey is hereby authorized to request the Board of Administration of the
Public Employees' Retirement System to grant to the City of Downey a
deferment of the current rate for one year, July 1, 1971 through June 30,
1972, and to sign an agreement with that agency authorizing said deferment
to become a liability to be funded through June 30, 2000; and
BE IT FURTHER RESOLVED, that the City Council of the City of Downey
gives, and it does hereby give, notice of intention to approve an Amendment
to Contract between said City Council and the Board of Administration of
the Public Employees' Retirement System as hereinabove set forth.
BE IT FURTHER RESOLVED, that the selection compelled hereunder is made
under protest by the City Council of the City of Downey in that it is the
position of the City Council that the provisions of Senate Bill 249
(Grunsky, et al) are not mandatory to the City, as a Charter City, but that
this selection is made solely in the interest of preserving the City's
rights.
The City Clerk shall certify to the adoption of this Resolution.

City Council of the City of Downey at a regular adjourned meeting thereof
held on the 28th day of June, 1971, by the following vote, to wit:
