HomeMy WebLinkAboutResolution No. 2506 RESOLUTION NO. 2506 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING CONDEMNATION PROCEEDINGS ON FIRESTONE BOULEVARD AT NEWVILLE AVENUE. THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council hereby finds, determines and declares that the public interest and necessity require the acquisition of rights -of -way in, on, over, and under the hereinafter described real property for public street purposes and all uses appurtenant thereto. That the location of the land for said street has been planned and located in the manner which will be most compatible to the greatest public good and the least private injury. SECTION 2. That the City Council finds, determines and declares that, in order to acquire said rights -of -way in, on, over and under said land for said street purposes and use the same for said purposes, the public interest, convenience and necessity require the acquisition of the rights -of -way by the City of Downey, in, on, over and under that certain real property hereinafter described, and the City Council hereby declares that it is the intention of the City of Downey to acquire in its name rights -of -way in, on, over and under said hereinafter described real property by condemnation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California authorizing the exercise of the right of eminent domain. SECTION 3. That said real property, the acquisition of which is required by public interest, convenience and necessity for the purpose set forth in Sections 1 and 2 hereof, is described as follows: That portion of Lot 1 of Tract No. 22672, in the City of Downey, in the County of Los Angeles, State of California, per Map recorded in Book 608, page 13 of Maps, in the Office of the County Recorder of said County, described as follows: Beginning at an angle point in the northeasterly line of Firestone Boulevard, 106 feet wide, as shown on said Map; thence South 59 ° 14'20" East (along the prolongation of that course shown on said Map as having a length of 535.56 feet) a distance of 0.83 feet, to the beginning of a tangent curve concave southwesterly, having a radius of 1,450 feet; thence southeasterly along said curve 68.74 feet to the northwesterly line of said Lot and the true point of beginning of this description; thence continuing southeasterly along said curve 79.98 feet to a point of tangency with a line parallel with and distant northeasterly 7.00 feet, measured at right angles, to the southwesterly line of said Lot 1; thence along said parallel line South 53 ° 38'20" East 43.53 feet to the beginning of a tangent curve concave northerly having a radius of 15 feet; thence easterly along said curve 12.07 feet to a point of cusp with the Boundary of said Lot 1 (an easterly continuation of said 15 -foot radius curve is tangent to the southwesterly prolongation of the southeasterly line of said Lot 1); thence westerly along the Boundary of Lot 1, being a curve concave northerly, having a radius of 25 feet, 25.13 feet to a point of tangency with the northeasterly line of Firestone Boulevard 106 feet wide; thence along said northeasterly line North 53 ° 38'20 "West 105.74 feet to the most westerly corner of said Lot 1; thence North 31 ° 25'30" East along the northwest line of said Lot, 5.18 feet to the true point of beginning. SECTION 4. That the City Attorneys of the City of Downey, Burke, Williams and Sorensen, hereby are authorized, empowered, and directed to prepare, institute and prosecute in the name of the City of Downey, such proceedings in the proper court having jurisdiction thereof as are necessary for the condemnation of said rights -of -way in said real property described in Section 3 of this Resolution. Said Attorneys hereby are authorized and empowered to take such procedure as may be necessary to secure an order of immediate possession for the use of and occupancy of said property. SECTION 5.
