HomeMy WebLinkAboutResolution No. 2438 RESOLUTION NO. 2438 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING ANNEXATION OF A CERTAIN AREA TO THE DOWNEY CITY LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THAT AREA UNTIL JANUARY 31, 1983 (ANNEXATION 70/24 - HORTON AVENUE, ET AL) WHEREAS, the City Council of the City of Downey on July 13, 1970, adopted Resolution No. 2429, declaring its intention to order certain improvements; and WHEREAS, on July 13, 1970, the City Council by Resolution No. 2429 appointed the hour of 7:30 p.m., August 10, 1970, in the Council Chambers of the City Hall of the City of Downey, as the time and place for hearing protests in relation to the proposed improve- ments; and WHEREAS, on August 10, 1970, at the time and place as specified, a public hearing was held in relation to the improvements, all in accordance with Resolution No. 2429, notice having been given in the manner required by law; and WHEREAS, at the hearing the City Council did pass upon all written and oral protests made in reference to the improvement: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The boundaries of that area to be annexed to the Downey City Lighting District are described on Plan Number SL -142 and legal description on file in the office of the City Clerk and by this reference are made a part hereof. SECTION 2. (a) The area of this improvement shall be annexed into Zone IV for the period beginning July 1, 1971, and ending June 30, 1973, for the purpose of levying energy and installation costs. (b) The area of this improvement shall then be annexed into Zone I for the period beginning July 1, 1973, and ending January 31, 1983 for the purpose o`f levying energy and maintenance costs only. SECTION 3. The improvement consists of the furnishing of maintenance and energy for street lighting as described in the Report of the Director of Public Works dated July 13, 1970, and as approved by the City Council. SECTION 4. The entire estimated cost of the improvement shall be borne by the District, and shall be paid by special assessment taxes levied upon all the lands and improvements within Zone IV. SECTION 5. The improvement described in Resolution No. 2429 and the Report of the Director of Public Works submitted pursuant to Resolution No. 2428 shall be made in the manner and at the times prescribed by law. SECTION 6. The City Council finds that the Southern California Edison Company and subject to the jurisdiction of the Public Utilities Commission of the State of California, is the only contractor practically capable of serving the street lighting improvement in the manner provided for and as described herein. It is, therfore, ordered that the improve- ment of the Lighting District be carried out by the Southern California Edison Company in accordance with said plans and specifications. SECTION 7. The Mayor is authorized and directed to execute the contract with the Southern California Edison Company for the improvement in accordance with said plan and specifications and in accordance with rates and rules filed by said Company from time to time with the Public Utilities Commission of the State of California. SECTION 8. The City Clerk shall certify to the adoption of this resolution and cause a certified copy thereof and the map or plan of the district to be filed with the assessor whose roll is used for the levy and with the State Board of Equalization and further shall cause a copy of this resolution to be published once in the South- east News and Downey Champion.
