A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING AND IMPLEMENTING REVISIONS TO THE PERSONNEL
MANUAL
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. That Table II, Classification Plan of that certain document
entitled City of Downey Personnel Manual, is hereby amended effective July 1,
1970 by changing certain of its salary schedule designations to the schedule
numbers or letters shown on the attached Exhibit "A ". Those classes for
which no designation is shown retain their 1969 -70 schedule numbers until
changed by Council action.
SECTION 2. That Table I, Pay Plan following page 4 of that certain
document entitled City of Downey Personnel Manual be and the same is hereby
amended by adding schedule designations, rates, and a note governing applica-
tion of part time rates, as shown on the attached Exhibit "B ", effective
July 1, 1970.
SECTION 3. That Section 10.3, Compensation for Overtime, Article I,
Pay Plan of Part II, Compensation of that certain document entitled City of
Downey Personnel Manual be amended to read as follows:
(a) "SECTION 10.3: Compensation for Overtime: All approved over-
time for employees paid on a schedule basis shall be paid at a straight time
hourly rate equal to the regular equivalent hourly rate of such employee, or
by compensatory time off with pay for a period equal to the time such
overtime work was performed, except for those employees paid in accordance
with the provisions of Section 10.4 of this Article."
SECTION 4. That Section 10.4, Section 10.5, Section 10.6 be added to
Article I, Pay Plan of Part II, Compensation of that certain document
entitled City of Downey Personnel Manual to read as follows:
(a) "SECTION 10.4: Time and One -Half Compensation. All approved
overtime worked in excess of eight continuous hours in one day shall be
paid at time and one -half the hourly rate of such employee, or by compensa-
tory time off at the rate of one and one -half times the number of hours of
such overtime worked. Employees paid in accordance with the provisions of
this Section shall be limited to Miscellaneous Employees at the salary
classification of Foreman or below. (1970 -71 Schedule 22.)
(b) The provisions of Section 10.4, Time and One -Half Compensation
shall not become effective until January 1, 1971.
(c) SECTION 10.5: Compensation for Special Call In: A miscella-
neous employee called in to perform work at times other than those normally
required for his employment shall have the option to be paid a minimum of
four (4) hours at straight time hourly rate equal to the regular hourly rate
of such employee, or by compensatory time off with pay for a period equal to
the time Special Call In time was accumulated. Employees may accumulate
Special Call In time to a maximum of forty (40) hours, and thereafter all
Special Ca11 In time shall be paid on the payday for the pay period in which
it was earned.
(d) SECTION 10.6: Miscellaneous Employees Defined. For the
purpose of this Part, Miscellaneous Employees mean all employees other than
sworn, Safety members of the Fire Department and Police Department."
SECTION 5. That Article III, Section 1, Section 2, and Section 2.1 be
added to Part II, Compensation of that certain document entitled City of
Downey Personnel Manual to read as follows:
(a) "ARTICLE III, Benefits
(b) SECTION 1: Employee Medical and Life Insurance Benefits:
When any permanent employee or officer in a position shown in Part II,
Article II, is enrolled in a medical and /or life insurance plan approved by
the City, the City shall contribute the total sum of the employee's or
officer's medical and life insurance premium, and the sum shall be paid by
the City to the medical group or company designated by the City.
(c) SECTION 2: Dependent Medical Benefits: When any dependent, as
defined in Section 2.2 of this Article, or any permanent employee or officer
in a position provided for in Part II, Article II, is enrolled in a medical
plan approved by the City, the City shall contribute twenty -five percent of
the dependent's medical premium, which shall be paid by the City to the
medical group or company designated by the City.
(d) SECTION 2.1: Dependent Defined: For the purpose of this Part,
a dependent shall mean the employee's spouse, and those unmarried, legally
dependent children who are subject to the provisions of the medical group or
company designated by the City to provide the insurance coverage."
SECTION 6. The medical compensation plan for employee dependents shall
become effective October 1, 1970.
SECTION 7. That Procedure VI Attendance and Leaves, Section 7c
Computation, of that certain document entitled City of Downey Personnel
Manual be amended to read as follows:
"1) All eligible employees shall accrue vacation leave in accordance
with the following schedule:
0 - 3 years 10 days
4 - 5 years 12 days
6 - 15 years 15 days
over 15 years one additional day per year of service
to maximum of 20 days.
No vested rights of present employees shall be affected by this
provision.
2) Each eligible employee, after six months of satisfactory, con -
tinous service, shall be entitled to whatever vacation time he has accumulated
provided, however, that the times during a year at which an employee may take
his vacation shall be determined by the department head with due regard for
the wishes of the employee and particular regard for the needs of the service.
3) All eligible employees shall be allowed to accumulate two years
allowance of vacation, except if prohibited by supervision in which case
maximum may be exceeded by such amount or the time lost may be paid.
4) When an employee, who has become entitled to a vacation with pay
which has not been used at the time he terminates, is terminated, enters the
armed forces or is laid off, he shall receive pay for such unused vacation as
he is entitled to under the provisions above."
SECTION 8. That Section 4 be added to Procedure X, Reports and Records
of Part III, Personnel Procedures of that certain document entitled City of
Downey Personnel Manual to read as follows:
"(a) SECTION 4: Job Performance Rating: Every classified employee
shall receive an objective, written job performance rating no sooner than
three (3) weeks before, and no later than five (5) working days before the
date of eligibility for a salary step or Merit Longevity increase, and
annually thereafter upon progressing to Step "E" of the salary schedule, or
upon a change of employment status as described in Part III, Procedure VII.
Nothing in this section shall prohibit the department head or authorized
supervisor from giving an additional objective rating to an employee between
those periods of time described in this section.
•— (b) SECTION 4.1: Rating Responsibility: It shall be the duty of
the department head to delegate the responsibility of every employee's rating
to that level of supervision having the authority to supervise the employee.
No classified employee below the administrative level shall be rated by less
than two of his immediate supervisors, each of whom shall discuss the rating
with the employee. The right of appeal to the department head shall not be
denied to the employee.
(c) SECTION 4.2: A reduction within the limits of the salary range
established for the employee's class, or the withholding of a salary step or
Merit Longevity increase beyond the employee's anniversary date, shall have
the written approval of the department head, and the right of appeal to the
Personnel Officer shall not be denied the employee."

SECTION 9. That Section 15: Employee Disability Leave: Procedure VI
Attendance and Leaves of Part III, Personnel Procedures of that certain
document entitled City of Downey Personnel Manual be amended to read as
follows:
"SECTION 15: Employee Disability Leave:
a) This Section establishes a disability leave plan at 75% of base
salary for full time employees having more than one year continuous service
with the City, and who have exhausted all accumulated sick leave, vacation,
and compensatory time due to a non - industrial illness or injury, under the
following eligibility schedule.

b) Application for disability leave shall be made by the employee
through his department head, to the City Manager, accompanied by full medical
justification from a physician chosen by the City at the direction of the
City. Failure to submit to such an examination shall be a basis for
terminating disability leave.
If the City Manager approves the application, he shall notify the
employee.
c) The employee shall reimburse the City one -half of the time used
at a minimum rate of one -half day sick leave per month, or may contribute
vacation or compensatory time to accelerate his reimbursement.
d) When the "Maximum Time Allowance" has been reimbursed as set
forth above, the employee shall be eligible to apply for additional
Disability Leave on the basis of one day's leave for each half day reimbursed
to the City; provided that no employee shall receive more than the "Total"
set forth above for his length of service, during his entire employment with
the City.
e) Disability leave shall not deprive an employee of his right to
vacation and sick leave accumulation during such leave.
f) Grounds for termination by the City Manager shall include but
not be limited to the following reasons:
1) The employee has recovered from his illness or injury.
2) The leave is being used as a pre- retirement leave for purpose
of postponing retirement or pension.
3) The disability leave was procured by fraud, misrepresentation,
or mistake.
4) The employee has not cooperated fully in supplying all in-
formation and submitting to any examination requested by the
City.
g) Disability Leave may not be used for non - emergency medical or
dental care and it may not be accumulated beyond the above limits."
SECTION 10. The City Clerk shall certify to the adoption of this
Resolution.
