HomeMy WebLinkAboutResolution No. 2409 RESOLUTION NO. 2409 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO ANNEX CERTAIN AREAS TO THE DOWNEY CITY LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO STREET LIGHTING FIXTURES ON THE STREETS AND PUBLIC PLACES WITHIN THOSE AREAS UNTIL JANUARY 31, 1983. (ANNEXATIONS 70/12 THROUGH 70/22, OMITTING 14, 15, and 21) THE CITY COUNCIL OF THE CITY OF DOWNEY HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Downey to order the annexation of certain areas to the Downey City Lighting District, including that northerly portion of Area 20 as shown on Plan No. SL -150, which is to be dissolved from the Downey County Lighting District and concurrently annexed into the Downey City Lighting District, and to maintain and furnish electrical current to street lighting fixtures located on portions of streets and other public places as shown on Plans Nos. SL -141, 143, 146, 147, 148, 149, 150, and 152 on file in the office of the City Clerk, from the date of formation of the District until January 31,1983, in accordance with the Report of the Director of Public Works dated June 23, 1970, on file in the Office of the City Clerk and which by this reference is made a part hereof. SECTION 2. This annexation, in the opinion of the City Council, is of more than ordinary benefit and the Council hereby makes the expense of said work and improvements chargeable upon the districts benefitted and to be assessed to pay the cost and expense thereof. The districts are those portions of the City of Downey shown on the above specified Plans on file in the Office of the City Clerk, on which the boundaries thereof are described by a boundary line. Reference is hereby made to the plans for a complete and detailed description of the districts; the plans on file shall govern for all details as to the extent of the assessment district. SECTION 3. Any lots or parcels of land known as public property, as defined in Section 18014 of the Streets and Highways Code of the State of California ( "Street Lighting Act of 1919 "), which are included in the said assessment districts shall be exempt from assessment to be made to cover the costs and expenses of said contemplated improvements. SECTION 4. The improvements contemplated shall be done under the provisions of the "Street Lighting Act of 1919 ", Part I of Division 14 of the Streets and Highways Code of the State of California (as amended), and under the alternative procedure for ad valorem assessments provided for in Chapter 8.5 of the "Street Lighting Act of 1919 ". SECTION 5. Pursuant to the provisions of Section 18070 of Streets and Highways Code, the City Council of the City of Downey hereby appoints the hour of 8:00 o'clock A.M., July 28, 1970, in the Council Chambers in the City Hall of said City as the time and place for hearing protests in relation to the proposed annexations. -2- SECTION 6. The City Clerk shall give notice of this hearing in the manner provided in Part I, Division 14 of the Streets and Highways Code. The publication of such notice shall be in the "Southeast News and Downey Champion ", a newspaper published and circulated in the City and hereby designated by said City Council for purpose of publication. SECTION 7. The Director of Public Works of the City of Downey shall cause to be conspicuously posted along all streets in the district where the improvement is proposed to made hor which feet is to be assessed for the benefits thereof, at apart, but not less than 3 in all, notices of the passage of the resolution as required by Section 18071 of said Streets and Highways Code. SECTION 8.
