A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
REQUESTING THE STATE LEGISLATURE TO MAKE MORE EQUITABLE
THE LAW RELATIVE TO COMPENSATION IN CASES OF EMINENT DOMAIN
WHEREAS, the rapid population growth of the State of California has
necessitated the construction of roads and highways in order to accommodate the
vehicular traffic; and
,--• WHEREAS, this construction has required the acquisition of property; and
WHEREAS, many of the property owners, whose property has been acquired,
have liens against their property which were placed upon the property at a
time when more favorable interest rates prevailed; and
WHEREAS, in order for property owners to now acquire property, it is often
necessary that they pay an interest rate greatly in excess of that which formerly
they paid in addition to loan costs and points; and
WHEREAS, it is inequitable that property owners, whose property is being
acquired, must pay the additional interest and other costs without receiving
reimbursement for these sums as part of the eminent domain settlement; and
WHEREAS, the City Council of the City of Downey believes that this inequity
is something to which the State Legislature should address itself,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the State Legislature is hereby requested to consider
amending the present laws of this State so as to require payment to a property
owner of the increased interest expense and other costs of obtaining a loan
which results by the exercise of the Power of Eminent Domain, by the State
Department of Public Works and /or other agencies, of the property owner's land.

SECTION 2. That the City Clerk of the City of Downey transmit copies of
this Resolution to the Honorable Ronald Reagan, Governor of the State of
California; Honorable Lawrence Walsh, Senator, 30th Senatorial District;
Honorable Joseph Kennick, Senator, 33rd Senatorial District; Honorable Carley
Porter, Assemblyman, 38th Assembly District, Honorable Jack Fenton, Assemblyman,
51st Assembly District; Honorable Floyd Wakefield, Assemblyman,52nd Assembly
District.
SECTION 3. The City Clerk shall certify to the adoption of this
Resolution.
