A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING ANNEXATION OF CERTAIN AREAS TO THE DOWNEY CITY
LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL
CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON
STREETS AND PUBLIC PLACES WITHIN THOSE AREAS UNTIL
JANUARY 31, 1983 (ANNEXATION G - AREAS 14 THROUGH 22
OMITTING AREA 18.)
WHEREAS, the City Council of the City of Downey on October 28, 1969,
adopted Resolution No. 2312, declaring its intention to order certain
improvement; and
WHEREAS, on October 28, 1969, the City Council by Resolution No. 2312
appointed the hour of 7 :30 p.m., December 8, 1969, in the Council Chambers
of the City Hall of the City of Downey, as the time and place for hearing
protests in relation to the proposed improvements; and
WHEREAS, on December 8, 1969, at the time and place as specified,
a public hearing was held in relation to the improvement, all in
accordance with Resolution No. 2312, notice having been given in the
manner required by law; and
WHEREAS, at the hearing the City Council did pass upon all written
and oral protests made in reference to the improvement;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE
AS FOLLOWS:
SECTION 1. The boundaries of the areas to be annexed to the
Downey City Lighting District are described on Plans Numbers 58, 118, 119,
122, 123, 124, 125 and 126, and legal descriptions on file in the office of
the City Clerk and by this reference made a part hereof.
SECTION 2. The areas of this improvement shall be annexed into
Zones I and III for the period beginning July 1, 1970 and ending
January 31, 1983, for the purpose of levying energy and maintenance costs.
SECTION 3. The improvement consists of the furnishing of maintenance
and energy for street lighting as described in the Report of the Director
of Public Works dated October 28, 1969, and as approved by the City Council.
SECTION 4. The entire estimated cost of the improvement shall be
borne by the District, and shall be paid by special assessment taxes
levied upon all the lands and improvements within the District.
SECTION 5. The improvement described in Resolution No. 2312 and the
Report of the _Director of Public Works submitted pursuant to Resolution
No. 2311 shall be made in the manner and at the times prescribed by law.
SECTION 6. The City Council finds that the Southern California
Edison Company and subject to the jurisdiction of the Public Utilities
Commission of the State of California, is the only contractor practically
capable of serving the street lighting improvement in the manner provided
for and as described herein. It, therefore, is ordered that the improve-
ment of the Lighting District be carried out by the Southern California
Edison Company in accordance with said plans and specifications.
SECTION 7. The Mayor is authorized and directed to execute the
contract with the Southern California Edison Company for the improvement
in accordance with said plan and specifications and in accordance with
rates and rules filed by said Company from time to time with the Public
Utilities Commission of the State of California.
SECTION 8. The City Clerk shall certify to the adoption of this
resolution and cause a certified copy thereof and the map or plan of
the district to be filed with the assessor whose roll is used for the
levy and with the State Board of Equalization and further shall cause
a copy of this resolution to be published once in the Southeast News
and Downey Champion.
