A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY ADOPTING STANDARDS FOR
THE ISSUANCE OF PERMITS FOR BUS BENCHES.
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. Each application for a bus bench permit to be issued
pursuant to the terms of Section 4134 of the Downey Municipal Code shall
be signed by the applicant and shall be in the form approved by the
City Manager. The application shall state the proposed location, the
style and design of the proposed bench and the advertising, if any,
which is proposed to be placed thereon.
A fee of $1.00 for each bench sought by the application shall be
paid at the time of filing. At the time of the application for a bus
bench permit the City Manager shall cause notice to be mailed to the
owners or occupants of improved property within 100 feet of the proposed
location. Notice shall be by certified mail and shall be not less than
15 days prior to the issuance of the permit.
SECTION 2. The City Manager, after reviewing the application and
making such investigation as he shall deem necessary, may issue a
permit subject to the conditions and restrictions imposed by this
resolution. No permit for a bus bench shall be issued unless the pro-
posed bench will be in a location and placed in such a manner as to
provide a convenience to passengers using public transportation (for
the purposes of this resolution public transportation shall not include
school buses.) However, under special circumstances permits may be
issued for other locations where recommended by the City Manager and
approved by the City Beautification Committee.
SECTION 3. The City Manager shall not authorize more than one bench
at any scheduled bus stop without the written approval of the Citizens
Beautification and Development Committee. In order to obtain such
approval the applicant shall submit to the City Manager the reasons for
the request setting forth why, in his opinion, such additional bench
is needed for the convenience of bus passengers.
SECTION 4. No advertising shall be permitted on any bus bench
adjacent to residential property. For courtesy benches there shall be
not more than two lines of lettering: the first line shall be "Courtesy
of" in letters not more than 4 inches high, the second line shall be
the name of the firm in letters not more than 6 inches high.
On any bench upon which advertising is authorized by the permit,
the advertising shall cover not more than 75% of the area on each front
and back panel of the bench. Such advertising shall not be permitted
until the design, style, and content thereof have been approved in
writing by the City Manager.
SECTION 5. No permit shall be issued for a bus bench that does
not have dimensions of 42" x 30" x 84" and until the bench has been
approved as to style and design by the Citizens Beautification and
Development Committee and the Department of Public Works.
SECTION 6. All bus benches shall be placed and anchored 18" from
the face of the curb and not more than 25 feet from the bus stop the
bench serves.
(a) Installation shall be on existing asphaltic concrete or cement
concrete.
If no such surface is available the permittee shall install
a concrete pad not less than 48" x 96" in size. Such pad shall
extend from the inside edge of the curb and shall be constructed
in accordance with the standards of the Department of Public Works.
(b) Permittee shall not allow any space between the bus bench
pad and adjacent appurtenances which would tend to allow the
accumulation of trash or weeds.
(c) Where existing parkway widths are less than 48 inches permittees
shall pave the entire width of the parkway.
(d) No bus benches shall be installed on curbside sidewalks which
have a width of less than 8 feet from the face of the curb.
SECTION 7. Each bus bench shall bear the name, address, and tele-
phone number of the owner of the bench in letters not less than one inch
in height and not more than two inches in height.
SECTION 8. At the time of the issuance of any permit the permittee
shall furnish proof of insurance coverage in amounts not less than the
minimum required in standard specifications for Public Works construction.
SECTION 9. No bus bench shall contain any advertising which may
tend to be confusing to traffic or contain the words "stop ", "warning"
or other phrases or diagrams which are common to traffic control signals
or devices.
SECTION 10. Each bus bench shall be inspected by the permittee
at least once every 90 days and report of such inspection shall be made
to the City Manager within 10 days after inspection. Each bus bench
shall be maintained by the permittee in a good, safe, neat, and clean
condition. Permittee shall repair, remove, or replace any designated
bus bench within 10 days after notification by the City Manager, pro-
vided, however, that in the event the City Manager determines that the
same is unsafe or creates a dangerous or defective condition he may
order the same removed within 24 hours. If any bench is not repaired
or removed by the permittee within the time specified by the City
Manager the same may be removed by the City and the costs thereof shall
be chargeable to the permittee. In the event such costs are not paid
upon demand therefor all benches of the permittee shall be subject to
removal by the City and sale by the City until the amount received from
such sale covers the costs and expenses incurred by the City in the
removal, storage, and sale of any bench.
SECTION 11. No permit shall be issued until the permittee signs
and files with the City a written statement that he is familiar with
the terms and conditions of this resolution and consents to the same
and accepts the permit subject to such terms and conditions.
SECTION 12. The authorities and the duties of the City Manager
as specified herein may be delegated by him to such staff member or
department as he deems advisable.
SECTION 13. The City Clerk shall certify to the adoption of this
resolution.
