RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING THAT AN UNDERGROUND UTILITY DISTRICT IS FORMED
PURSUANT TO RESOLUTION NO. 2221 (DISTRICT NO. 2)
WHEREAS, pursuant to Resolution No. 2221 a public hearing was held
on May 12, 1969, by the City Council of the City of Downey; and
WHEREAS, notice of such hearing was given in the manner required by
law; and
WHEREAS, such hearing duly has been held and all persons interested
were given an opportunity to be heard.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE
AS FOLLOWS:
SECTION 1. That it hereby finds and determines that the public
necessity, health, safety and welfare require the removal of poles, over-
head wires and associated structures and the underground installation of
wires and facilities for supplying electrical, communications or similar
or associated service in the civic area of the City of Downey along the
easterly and westerly frontage of Paramount Boulevard and the northerly
frontage of Third Street as shown on Plan No. 2..18-255. The boundary of
Underground Utility District No. 2 is further described in detail by a
legal description which is filed in the office of the City Clerk along
with Plan No. 2- 18•255 which by this reference are made a part hereof.
SECTION 2. Those poles, overhead wires and associated overhead struc-
tures on the easterly and westerly frontage of Paramount Boulevard and the
northerly frontage of Third Street between the Southern Pacific Railroad
and Third Street shall be removed and underground installations made in
said Underground Utility District within the following times:
(a) Underground installation by utility companies and property
owners and reconnections not later than January 1, 1970,
provided, however, utility companies upon a showing that
they cannot comply with such limitations may, upon approval
of the City Council have an extension of time not to exceed
120 days.
(b) Removal of poles, overhead wires and other associated over-
head structures not later than January 1, 1970, provided,
however, utility companies upon a showing that they cannot
comply with such limitation may, upon approval of the City
Council have an extension of time not to exceed 120 days.
SECTION 3. The City, within ten (10) days after the adoption of this
resolution shall mail a copy of the same and a copy of Chapter 5, Article VII
o:E the Downey Municipal Code to affected property owners as such are shown
on the last equalized assessment roll and to the affected utilities.
SECTION 4. The City Clerk shall certify to the adoption of this
resolution.
