A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF DOWNEY FINDING AND DETERMINING THAT THE
PUBLIC INTEREST, CONVENIENCE AND NECESSITY
- REQUIRE THE ACQUISITION OF CERTAIN PROPERTY
AND FACILITIES FOR THE PURPOSE OF CONDUCTING,
STORING AND DISTRIBUTING WATER FOR THE USE
OF SAID CITY.
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the City Council hereby finds, determines
and declares that the public interest, convenience and necessity
require the acquisition, for the use of the City of Downey, of
the hereinafter described property, water rights and facilities
located within the City of Downey now owned by Park Water Company,
a corporation, (all of which hereinafter is referred to as "said
property ") for the purpose of conducting, storing and distribut-
ing water and all uses appurtenant thereto.
That the acquisition by the City of said property, water
rights and facilities as hereinafter described is for the pur-
pose of supplying water to the City and its inhabitants and is
necessary for the proper development of the City and that the
use and development of said property has been planned in the
manner which will be most compatible to the greatest public good
and the least private injury.
SECTION 2. That the City Council finds, determines and
declares that in order to acquire, for the use of the City, said
property and facilities for conducting, storing and distribut-
ing water and for the use of the same for said purposes, the
public interest, convenience and necessity require the acqui-
sition of said property and facilities by the City of Downey
as are hereinafter described. The City Council hereby declares
it is the intention of the City of Downey to acquire full title,
free and clear of all liens and encumbrances, to said property
and facilities by condemnation in accordance with the provisions
of the Code of Civil Procedure, the Government Code, the Public
Utilities Code and the Constitution of the State of California
authorizing the exercise of the right of Eminent Domain.
SECTION 3. That said property and facilities, the acqui-
sition of which is required by the public interest, convenience
and necessity in the manner and for the purpose set forth are
described as follows:
All property and facilities of whatever kind or
character owned by Park Water Company and used
in the operation of said Park Water Company
system within that portion of the City of Downey
hereinafter described for the conducting, storing
and distributing of water or pertinent to such
use, including but not limited to the following:
Pumping equipment, motors, pipes and pipelines,
meters, service connections, fire hydrants, aque-
ducts, flumes pumps and tanks and the interests
and other real property necessary therefor all
within said described area.
Except, however, the City does not intend to
acquire any of the following property owned
by Park Water Company:
Office equipment, furniture, fixtures, stationery,
motor vehicles or other office facilities not
used exclusively within said area.
The area within which such property is contained is des-
cribed as follows
That portion of the Rancho Santa Gertrudes in the
City of Downey, County of Los Angeles, State of
California bounded on the northwest by the center-
line of the Rio Hondo Channel (400 feet wide) as
shown on the County Surveyors Filed Map No. 18225,
Sheet 8; on the northeast by the southwesterly line
of Tract No. 17849 and its prolongation per Map
Recorded in Book 485, Pages 1 thru 4 in the Office
of the County Recorder of said County; on the south-
east by the centerlines of Old River School Road and
Tecum Avenue per Maps Recorded in said Recorder's
" - ' Office in Book 293, Pages 17 and 18, Book 20, Page
155, Book 485, Pages 1 thru 4; on the southwest by
the southwesterly line of Tract 14227 and its pro -
longation per Map Recorded in Book 293, Pages 17
and 18 in said Recorder's Office.

SECTION 4. That the City Attorney of the City of Downey
and Burke, Williams & Sorensen hereby are authorized, empowered
and directed to prepare, institute and prosecute in the name of
the City of Downey such proceedings in the proper court having
jurisdiction thereof as are necessary for the condemnation of
said property and facilities described in Section 3 of this
Resolution.
SECTION 5. The City Clerk shall certify to the adoption
of this Resolution.

was adopted at a regular meeting of the City Council of
the City of Downey held on the 25th day of March 1969,
