A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY,
CALIFORNIA, IN OPPOSITION TO THE LATEST COURT CONSOLIDATION
PLAN SUBMITTED TO THE STATE LEGISLATURE AS ASSEMBLY
BILL NO. 238
WHEREAS, Assembly Bill No. 238 would consolidate the existing
localized judicial districts into nine judicial districts; and
WHEREAS, said consolidation has been attempted in varying forms in
recent years and in each instance defeated after a hearing thereon; and
WHEREAS, a consolidation plan utilizing existing court facilities
and personnel would not achieve any monetary saving; and
WHEREAS, the reorganization of districts into a smaller number would
result in requiring witnesses, officers, procecutors and counsel to
travel, in some instances, substantial distances in order to have cases
tried; and
WHEREAS, said consolidation would make thereby the municipal judicial
process more costly in terms of the time of witnesses, defendants, police
officers and other officials required by the cities involved in cases to
prosecute or defend; and
WHEREAS, this City Council favors the principle of home rule as it
relates to the election of judges from the communities which they serve;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE
AS FOLLOWS:
SECTION 1. The City Council of the City of Downey does hereby
oppose AB 238 and any proposal to consolidate the existing judicial
districts into a smaller number on the basis that it represents a de-
parture from the home rule principle and will not, if it were effectuated,
result in any savings or greater efficiency but on the contrary would result
in expense and inconvenience to all persons concerned.
SECTION 2. The City Clerk shall certify to the adoption of this
resolution.
