A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING ANNEXATION OF CERTAIN AREAS TO THE DOWNEY CITY
LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL
CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON THE
STREETS AND PUBLIC PLACES WITHIN THOSE AREAS UNTIL
JANUARY 31, 1983 (ANNEXATION F - AREAS 8 AND 10)
AREA 8 - ZONE III: Southwest corner Lakewood
Boulevard and Alameda Street
AREA 10 - ZONE I: East side Old River School
Road between Fostoria Street
and Muller Street
WHEREAS, the City Council of the City of Downey on November 12, 1968,
adopted Resolution No. 2158, declaring its intention to order those certain
improvements aforesaid; and
WHEREAS, on November 12, 1968, the City Council by Resolution No. 2158
appointed the hour of 7:30 P.M., DeceiPber 9, 1968, in the Council Chambers
of the City Hall of the City of Downey, as the time and place for hearing
protests in relation to said proposed improvements; and
WHEREAS, on December 9, 1968, at the time and place as specified, a
public hearing duly was held in relation to said improvements, all in
accordance with said Resolution No. 2158, notice having been duly given
of said hearing in the manner required by law; and
WHEREAS, at said hearing the City Council did pass upon all written
and oral protests made in reference to said improvement;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE
AS FOLLOWS:
SECTION 1. The boundaries of that area to be annexed to the Downey
City Lighting District are described on Plans Numbers SL -90 and SL -109
attached hereto and by this reference incorporated herein and made a part
hereof, the same as though set forth in full.
SECTION 2. The proposed improvement shall be for the period beginning
July 1, 1969, and ending January 31, 1983.
SECTION 3. The proposed improvement consists of the furnishing of
maintenance and energy for street lighting as described in accordance with
the Preliminary Report of the Director of Public Works dated November 6,
1968,and as approved by the City Council.
SECTION 4. The entire estimated cost of said improvement shall be
borne by the District.
SECTION 5. It hereby is ordered that the estimated cost proposed to
be borne by the District shall be paid by special assessment taxes levied
upon all the lands and improvements within the District.
SECTION 6. It hereby is ordered that said proposed improvement as
described and set forth in Resolution No. 2158 and the Preliminary Report of
the Director of Public Works submitted pursuant to Resolution No. 2157 be
made in the manner and at the times prescribed by law.
SECTION 7. That the City Council hereby finds that the Southern California
Edison Company is the only contractor practically capable of serving the street
lighting system to be improved in the manner provided for and as described herein
and the Southern California Edison Company is subject to the jurisdiction of
the Public Utilities Commission of the State of California. It, therefore, is
ordered that the improvement of the said lighting district be carried out in
accordance with said plans and specifications by the Southern California
Edison Company.
SECTION 8. It further is ordered that the Mayor hereby is authorized
and directed to execute the contract with the Southern California Edison
Company for the improvement in accordance with said plan and specifications
and in accordance with rates and rules filed by said Company from time to
time with the Public Utilities Commission of the State of California.
SECTION 9. The City Clerk shall certify to the adoption of this
resolution and cause a certified copy thereof and the map or plan of the
district to be filed with the assessor whose roll is used for the levy
and with the State Board of Equalization and further shall cause a copy
of this resolution to be published once in the "Southeast News and Downey
Champion."
