HomeMy WebLinkAboutResolution No. 2173 RESOLUTION NO. 2173 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING ANNEXATION OF CERTAIN AREAS TO THE DOWNEY CITY LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON THE STREETS AND PUBLIC PLACES WITHIN THOSE AREAS UNTIL JANUARY 31, 1983 (ANNEXATION F - AREA 7 - ZONE I) WHEREAS, the City Council of the City of Downey on November 12, 1968 adopted Resolution No. 2156 declaring its intention to order those certain improvements aforesaid; and WHEREAS, on November 12, 1968, the City Council by Resolution No. 2156 appointed the hour of 7 :30 P.M., December 9, 1968, in the Council Chambers of the City Hall of the City of Downey, as the time and place for hearing protests in relation to said proposed improvements; and WHEREAS, on December 9, 1968, at the time and place as specified, a public hearing duly was held in relation to said improvement, all in accordance with said Resolution No. 2156, notice having been duly given of said hearing in the manner required by law; and WHEREAS, at said hearing the City Council did pass upon all written and oral protests made in reference to said improvement; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The boundaries of that area to be annexed to the Downey City Lighting District are described on Plan No. SL -89 attached hereto and by this reference incorporated herein and made a part hereof, the same as though set forth in full. SECTION 2. The proposed improvement consists of the furnishing of maintenance and energy for street lighting throughout the District as described in accordance with the Preliminary Report of the Director of Public Works dated November 7, 1968 and as approved by the City Council. SECTION 3. The estimated annual operating cost of said improvement is $45.60. SECTION 4. The entire operation cost of said improvement shall be borne by the District, beginning July 1, 1969. SECTION 5. It hereby is ordered that the estimated cost proposed to be borne by the District shall be paid by special assessment taxes levied upon all the lands and improvements within the District. SECTION 6. It hereby is ordered that said proposed improvement as described and set forth in Resolution No. 2156 and the Preliminary Report of the Director of Public Works submitted pursuant to Resolution No. 2155 be made in the manner and at the times prescribed by law. SECTION 7. That the City Council hereby finds that the Southern California Edison Company is the only contractor practically capable of serving the street lighting system to be improved in the manner provided for and as described herein and the Southern California Edison Company is subject to the jurisdiction of the Public Utilities Commission of the State of California. It, therefore, is ordered that the improvement of the said lighting district be carried out in accordance with said plans and speci- fications by the Southern California Edison Company. SECTION 8. It further is ordered that the Mayor hereby is authorized and directed to execute the contract with the Southern California Edison Company for the improvement in accordance with said plan and specifications and in accordance with rates and rules filed by said Company from time to time with the Public Utilities Commission of the State of California. SECTION 9. The City Clerk shall certify to the adoption of this resolution and cause a certified copy thereof and the map or plan of the District to be filed with the assessor whose roll is used for the levy and with the State Board of Equalization and further shall cause a copy of this resolution to be published once in the "Southeast News and Downey Champion."
