A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING ITS INTENTION TO ANNEX CERTAIN AREAS TO THE
DOWNEY CITY LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH
ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES
LOCATED ON THE STREETS AND PUBLIC PLACES WITHIN THOSE
AREAS UNTIL JANUARY 30, 1983, (ANNEXATION F - AREAS 8 AND
10 - ZONES III AND I RESPECTIVELY)
THE CITY COUNCIL OF THE CITY OF DOWNEY HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the public interest and convenience require, and it
is the intention of the City Council of the City of Downey to order the
annexation of certain areas to the Downey City Lighting District, and to
maintain and furnish electrical current to those street Lighting fixtures
located on portions of streets, avenues, places, circles, parkways, courts,
ways and drives within said City, all as shown on Plan No. SL -90 and Plan
No. SL -109 on file in the office of the City Clerk for a period of time
beginning from the formation of the district and ending January 30, 1983,
in accordance with the Report of the Director of Public Works dated
November 6, 1968, on file in the office of the City Clerk and which is
hereby referred to and by this reference incorporated herein and made a
part hereof.
SECTION 2. The said annexation, in the opinion of the City Council, is
of more than ordinary benefit, said Council hereby makes the expense of said
work and improvement chargeable upon a district, which district said Council
hereby declares to be the district benefitted by said work and improvement,
and to be assessed to pay the cost and expense thereof, which said district is
that property located on the southwest corner of Lakewood Boulevard and Alameda
Street as shown on Plan Number SL -90 and also that property located along the
east side of Old River School Road between Fostoria Street and Muller Street
_ as shown on Plan No. SL -109 on file in the office of the City Clerk, on which
map the extent of said assessment district is indicated and the exterior
boundaries thereof are described by a boundary line, and to which said map
reference is hereby made for a complete and detailed description of said dis-
trict, excepting from said district any portion of any public street or alley
which may be included therein. The said diagram so on file shall govern for
all details as to the extent of said assessment district.
SECTION 3. Any lots or parcels of land known as public property, as the
same is defined in Section 18014 of the Streets and Highways Code of the
State of California ( "Street Lighting Act of 1919 "), hereinafter referred to
which are included in the said assessment district shall be omitted and exempt
from the assessment to be made to cover the costs and expenses of said con-
templated improvement.
SECTION 4. The improvement contemplated by the Resolution of Intention
shall be done under the provisions of the "Street Lighting Act of 1919 ", being
Part I of Division 14 of the Streets and Highways Code of the State of California,
as amended, and under the alternative procedure for ad valorem assessments
provided for in Chapter 8.5 of the "Street Lighting Act of 1919."
SECTION 5. Pursuant to the provisions of Section 18070 of said Streets
and Highways Code, the City Council of the City of Downey hereby appoints the
hour of 7 :30 o'clock P.M., December 9, 1968 in the Council Chambers in the
City Hall of said City as the time and place for hearing protests in relation
to the proposed annexation.
SECTION 6. The City Clerk shall give notice of said hearing in the manner
provided in said Part I, Division 14 of said Streets and Highways Code. The
publication of such notice, as required by Section 18072 of said Code, shall be
made in the "Southeast News," a newspaper published and circulated in the City
and hereby designated by said City Council for said purpose of publication.
SECTION 7. The Director of Public Works of the City of Downey shall
cause to be conspicuously posted along all streets in the district where
the improvement is proposed to be made or which is to be assessed for the
benefits thereof, at not more than 300 feet apart but not less than 3 in
all, notices of the passage of the resolution as required by Section 18071
of said Streets and Highways Code.
SECTION 8. The City Clerk shall certify to the adoption of this
resolution.
