HomeMy WebLinkAboutResolution No. 2151 RESOLUTION NO. 2151 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING ANNEXATION OF CERTAIN AREAS TO THE DOWNEY CITY LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON THE STREETS AND PUBLIC PLACES WITHIN THOSE AREAS UNTIL JUNE 30, 1971, (ANNEXATION F - AREA 9 - ZONE 4) (VULTEE AVENUE TO CHANEY AVENUE AND GOTHAM STREET TO BAYSINGER DRIVE) WHEREAS, the City Council of the City of Downey on October 14, 1968, adopted Resolution No. 2147 declaring its intention to order those certain improvements aforesaid; and WHEREAS, on October 14, 1968, the City Council by Resolution No. 2147 appointed the hour of 7 :30 P.M., November 12, 1968, in the Council Chamber of the City Hall of the City of Downey, as the time and place for hearing protests in relation to said proposed improvements; and WHEREAS, on November 12, 1968, at the time and place as specified, a public hearing duly was held in relation to said improvement, all in accordance with said Resolution No. 2147, notice having been duly given of said hearing in the manner required by law; and WHEREAS, at said hearing the City Council did pass upon all written and oral protests made in reference to said improvement; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The boundaries of that area to be annexed to the Downey City Lighting District are described on Plan No. SL -106 attached hereto and by this reference incorporated herein and made a part hereof, the same as though set forth in full. SECTION 2. The proposed improvement shall be for a period of two years beginning July 1, 1969, and ending June 30, 1971. SECTION 3. The proposed improvement consists of the furnishing of maintenance and energy for street lighting throughout the District as described in accordance with the Preliminary Report of the Director of Public Works dated September 20, 1968, and as approved by the City Council. SECTION 4. The estimated cost of said improvement for the first two years is $15,157.60, with maintenance costs only thereafter. SECTION 5. The entire estimated cost of said improvement shall be borne by the District. SECTION 6. It hereby is ordered that the estimated cost proposed to be borne by the District shall be paid by special assessment taxes levied upon all the lands and improvements within the District. SECTION 7. It hereby is ordered that said proposed improvement be modified by deleting therefrom that portion of Chaney Avenue between the northerly line of Via Amorita and the southerly boundary of the District as described and set forth in Resolution No. 2147 and the Preliminary Report of the Director of Public Works submitted pursuant to Resolution No. 2146 be made in the manner and at the time prescribed by law. SECTION 8. That the City Council hereby finds that the Southern California Edison Company is the only contractor practically capable of serving the street lighting system to be improved in the manner provided for and as described herein and the Southern California Edison Company is subject to the jurisdiction of the Public Utilities Commission of the State of California. It, thereby, is ordered that the improvement of the said lighting district be carried out in accordance with said plans and specifications by the Southern California Edison Company. SECTION 9. It further is ordered that the Mayor hereby is authorized and directed to execute the contract with the Southern California Edison Company for the improvement in accordance with said plan and specifications and in accordance with rates and rules filed by said Company from time to time with the Public Utilities Commission of the State of California. SECTION 10. The City Clerk shall certify to the adoption of this reso- lution and cause a certified copy thereof and the map or plan of the District to be filed with the assessor whose role is used for the levy and with the State Board of Equalization and further shall cause a copy of this resolution to be published once in the "Southeast News,gand Downey Champion ".
