HomeMy WebLinkAboutResolution No. 2105 RESOLUTION NO. 2105 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING THAT AN UNDERGROUND UTILITY DISTRICT IS FORMED PURSUANT TO RESOLUTION NO. 2101 (DISTRICT NO. 1) WHEREAS, pursuant to Resolution No. 2101 a public hearing was held on August 12, 1968, by the City Council of the City of Downey; and —' WHEREAS, notice of such hearing was given in the manner required by law; and WHEREAS, such hearing duly has been held and all persons interested were given an opportunity to be heard. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That it hereby finds and determines that the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated structures and the underground installation of wires and facilities for supplying electrical communication or similar or associated service in the civic area in that portion of land in the City of Downey, County of Los Angeles, State of California, described as follows: Beginning at the intersection of the centerline of Brookshire Avenue 80.00 feet wide, formerly Church Street 40.00 feet wide, as shown on Map of Tract 9457 recorded in Book 171, Page 7 of Maps in the office of the County Recorder of said County, with the centerline of Manatee Street 60.00 feet wide, firmerly South Street as shown on Map of Tract 14296 per Map recorded in Book 304, Pages 29 -31 of Maps in said Recorder's Office; thence northwesterly along the prolongation of said centerline of Manatee Street to the north- ._.._ westerly line of Brookshire Avenue 80.00 feet wide lying 40.00 feet on each side of the above - described centerline; thence north- easterly along said northwesterly line to the northwesterly prolongation of the southwesterly line of Land described in Deed to S. Huston recorded in Book 152 page 404 of Deeds in said Recorders office; thence south- easterly along said prolongation and southwesterly line to the north- westerly line of the southeasterly 243.41 feet of land so described in said Deed to Huston; thence northeasterly thereon to the centerline of Margaret Street 20 feet wide as described in Resolution of the City Council of the City of Downey recorded August 24, 1966, as Document 1666 in Book D 3407 page 834 of Official Records in said office; thence southeasterly thereon to the centerline of Patton Road, said centerline being the northwesterly line of Lot P of the Rancho Santa Gertrudes, per Map recorded in Book 32, page 18 of Miscellaneous Records in said office; thence southwesterly along said centerline of Patton Road to the center- line of said Manatee Street; thence northwesterly thereon to the point of beginning. SECTION 2. All poles, overhead wires and associated overhead structures shall be removed and underground installations made in said Underground Utility District within the following times: (a) Underground installation by utility companies and property owners and reconnections not later than January 1, 1969, provided, however, utility companies upon a showing that they cannot comply with such limitation may, upon approval of the City Council have an extension of time not to exceed 120 days. (b) Removal of poles, overhead wires and other associated over- head structures not later than January 1, 1969, provided, however, utility companies upon a showing that they cannot comply with such limitation may, upon approval of the City Council have an extension of time not to exceed 120 days. SECTION 3. The City, within ten (10) days after the adoption of this resolution shall mail a copy of the same and a copy of Chapter 5, Article VII of the Downey Municipal Code to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. SECTION 4. The City Clerk shall certify to the adoption of this resolution. APPROVED AND ADOPTED this 12th day of August , 1968.
