RESOLUTION NO,
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF DOWNEY CALLING A PUBLIC HEARING TO DETER-
MINE WHETHER THE PUBLIC NECESSITY, HEALTH,
SAFETY OR WELFARE REQUIRE THE FORMATION OF
AN UNDERGROUND UTILITY DISTRICT IN AND ABOUT
THE DOWNEY MUNICIPAL HOSPITAL.
WHEREAS, Chapter 5 of Article VII of the Downey Municipal
Code establishes a procedure for the creation of underground
utility districts; and
WHEREAS, it has been recommended that such an underground
utility district be formed as in this resolution set forth.
NOW, THEREFORE, the City Council of the City of Downey
does resolve as follows:
SECTION 1. Notice hereby is given that a public hear -
ing will be held by the City Council of the City of Downey on
August 12, 1968 at the hour of 7 :30 o'clock P.M. in the Council
"— Chambers at the City Hall Downey, California to ascertain whether
the public necessity, health, safety or welfare requires the re-
moval of poles, overhead wires and associated overhead structures
and the underground installation of wires and facilities for
supplying electric, communication or similar .associated service
in the following described district, which said district is shown
on that certain plan No. 2 -18 -218 on file in the office of the
City Clerk and is particularly described as follows:
That portion of . land in the City of Downey, County of
Los Angeles, State of California described as follows:
Beginning at the intersection of the centerline of
Brookshire Avenue 80.00 feet wide, formerly Church Street
40.00 feet wide, as shown on Map of Tract 9457 recorded
in Book 171, Page 7 of Maps in the office of the County
Recorder of said County, with the centerline of Manatee
Street 6o.00 feet wide, formerly South Street, as shown
on Map of Tract 1429E per Map recorded in Book 304, Pages
29 -31 of maps in said Recorder's Office; thence north-
westerly along the prolongation of said centerline of
Manatee Street to the northwesterly line of Brookshire
Avenue 80.00 feet wide, lying 40.00 feet on each side
of the above - described centerline; thence northeasterly
along said northwesterly line to the southwesterly line
of the right of way of the Southern Pacific Railroad;
thence southeasterly thereon to the southeasterly line
of said Brookshire Avenue; thence southwesterly thereon
to the centerline of Margaret Street, 20.00 feet wide;
thence southeasterly thereon to the centerline of
Patton Road, said centerline being the northwesterly
line of Lot P of the Rancho Santa Gertrudes, per Map
recorded in Book 32, Page 18 of Miscellaneous Records
in said office; thence southwesterly along said center-
line of Patton Road to said centerline of Manatee Street;
thence northwesterly thereon to the point of beginning.
SECTION 2. At such hearing all persons interested shall
be given an opportunity to be heard and said hearing may be con-
tinued from time to time as determined by the City Council.
SECTION 3. In the event the City Council after such
hearing determines to order the formation of such utility district
all work therein shall be done in accordance with and pursuant
to the provisions of Chapter 5 of Article VII of the Downey
Municipal Code consisting of Sections 7500 et seq. of said Code,
all improvements shall be completed by January 1, 1969 and the
cost thereof shall be borne respectively by the utility companies
and the properties benefitted in accordance with the provisions
of said Chapter 5.
SECTION 4. The City Clerk shall notify by mail all
affected property owners as shown on the last equalized assess -
ment roll and utilities concerned of the time and place of the
said hearing by mailing a copy of this resolution to such property
owners and utilities concerned at least ten (10) days prior to
August 12, 1968.
SECTION 5. The City Clerk shall certify to the adoption
of this resolution,
