HomeMy WebLinkAboutResolution No. 2098 RESOLUTION NO. 2098 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO VACATE THE SOUTHWESTERLY TEN FEET OF QUILL DRIVE NORTHWESTERLY OF OLD RIVER SCHOOL ROAD THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Downey, upon recommendation ot the Planning Commission, hereby declares its intention to vacate the south- westerly ten teet of Quill Drive northwesterly of Old River School Road as shown on Map on file in the Office of the City Clerk to which reference is made for further particulars, the area to be vacated being described as: That portion ot Lot "C" of the Rancho Santa Gertrudes in the City of Downey, County of Los Angeles, State of California, per Map recorded in Book 1, page 502 of Miscellaneous Records in the Office of the County Recorder of said County described as follows: th beginning at the intersection of the northwesterly line of land described in Deed to Old River School District recorded June 3, 1954 as Document 2097 in Book 44726, page 374 of Official Records, in said Recorder's Office, with a line parallel with and distant southwesterly 60.00 feet, measured at right angles, from the northeasterly line of Quill Drive as described in Resolution ot the Board of Supervisors of said County, recorded Sep - tember 24, 1954, as Document 2987 in Book 45670, page 363 of said Official Records; Thence South 58 ° 43'45" East along said parallel line 1210.29 feet to the beginning of a tangent curve concave westerly and having a radius of 1D.00 teet, said curve being also tangent to the northwesterly line of Old River School Road, 80 teet wide as described in Resolution of said Board Recorded in Book /79z, page 128 of said Official Records; thence southerly along said curve 18.46 feet to the Southwesterly line of the northeasterly 40 teet of said land of Alameda School District, a radial line ot said curve through this point bears South 78 ° 12'01" East; Thence North 58 ° 43'45" West along said southwesterly line 1224.64 feet to the northwesterly line of said land; thence North 31 East thereon ten teet to the point of beginning. SECTION 2. Pursuant to the authority ot Section 8330 and 8331 of the Streets and Highways Code ot the State of California, the City Council hereby determines that the public convenience and necessity require the reservation of a permanent easement and right at any time or trom time to time to construct, operate, maintain, replace, renew, enlarge and remove sanitary sewer lines and appurtenant structures, including access and the right to protect the same from all hazards, in, upon, and over that portion of the street proposed to be vacated and AND described hereinabove except the northwesterly 600 teet thereof. All proceedings for the vacation of said street are taken and shall be subject to the reservation of said described easement. SECTION 3. The hour of 7:30 P.M. on the 12th day of August, 1968, is hereby fixed as the time and the Council Chambers in the City Hall at 8425 Second Street, Downey, California, is hereby fixed as the place for hearing all persons objecting to the proposed vacation of said street. SECTION 4. The City Clerk shall cause this resolution to be published in the manner required by Section 8322 of the Streets and Highways Code of the State of California. SECTION 5. Notices of the proposed street vacation shall be posted in the manner prescribed by said Section 8322. SECTION 6. The City Clerk shall certify to the adoption of this resolution.
