A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY INCORPORATING A DISABILITY LEAVE PROGRAM
INTO THE PERSONNEL MANUAL
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. That that certain document entitled City of Downey Per -
sonnel Manual is hereby amended by adding a new SECTION 15 to PROCEDURE VI,
ATTENDANCE & LEAVES, thereof as follows:
SECTION 15. Employee Disability Leave.
a) Any employee who has been in the service of the City con -
tinuously on a full time basis for three years or more,
and who has exhausted his accumulated time off allowances
(not including disability leave provided for in this section)
due to a protracted non - industrial (not job related) illness,
may be allowed additional disability leave by the City Council
as provided in this section.
b) Application for disability leave shall be made by the em-
ployee through his department head, to the City Manager,
accompanied by full medical justification from a physician
chosen by the city at the direction of the city. Failure
to submit to such an examination shall be a basis for ter-
minating disability leave.
If the City Manager approves the application, he shall trans-
mit it to the City Council, together with his recommendation
for action.
1) Disability leave will be subject to reapproval by the
City Council, based on full medical justification, at
two month intervals.
2) No employee shall receive more than six months aggregate
disability leave during his entire employment with the
City.
3) Employees on disability leave shall be paid 507 of
their gross salary when on authorized disability
leave as provided in this Section.
4) Disability leave shall not deprive an employee of his
right to vacation and sick leave accumulation during such
leave.
5) Disability leave is granted and may be terminated at
the discretion of the City Council. Grounds for ter-
mination shall include, but shall not be limited, to
the following:
(a) That the employee has recovered from his illness
or injury.
(b) That the leave is being used as a pre- retirement
leave for the purpose of postponing retirement
or pension.
(c) That the order of the City Council allowing the
leave, was procured by fraud, misrepresentation,
or mistake.
(d) That the employee on leave has not fully
cooperated in supplying all information, and
submitting to any examination requested by the
City Council.
SECTION 2. The City Clerk shall certify to the adoption of this
resolution and shall provide for appropriate distribution thereof.
