A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE VACATION OF A PORTION OF SECOND STREET FROM
BROOKSHIRE AVENUE 275 FEET WESTERLY
WHEREAS, by Resolution No. 2011, the City Council of the City of Downey,
adopted December 11, 1967, declared its intention to vacate a portion of Second
Street, from Brookshire Avenue 275 feet westerly, as shown on Map on file in
the Office of the City Clerk, to which reference is made for further particulars;
and
WHEREAS, the public hearing on said intended vacation was duly held, and a
full and fair hearing was had thereon.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. The City Council of the City of Downey finds, from all evidence
submitted at said hearing, that this area is no longer necessary for street use,
and it is hereby ordered vacated. Said area to be vacated is described as follows:
That portion of Second Street as shown on Official Map filed
January 13, 1964, as Document 5097 in Book 4, Pages 76 - 78 of
Official Maps, in the Office of the County Recorder of the County
of Los Angeles, State of California, bounded on the East by a line
parallel with and distant northwesterly 40.00 feet, measured at
right angles from the centerline of Brookshire Avenue as shown on
said map and bounded on the West by a line parallel with said
Centerline of Brookshire Avenue and distant North 57 West
315 feet measured along the Centerline of said Second Street,
from the intersection of said Centerline of Brookshire Avenue;
bounded on the North and the South by the northerly and southerly
lines of Second Street, 60 feet in width as shown on said Map.
SECTION 2. Pursuant to the authority of Sections 8330 and 8331 of the Streets
and Highways Code of the State of California, the City Council hereby determines
that a public convenience and necessity require the reservation of a permanent
easement and right at any time, or from time to time, to maintain, operate, replace,
remove, renew and enlarge lines of pipes, conduits, cables, wires, poles and other
convenient structures and fixtures for the operation of gas pipe lines, telephone
and telegraph lines, and for the transportation and distribution of water,
electrical energy and incidental purposes, including access and the right to keep
the property free from flammable materials and weed growth, and otherwise protect
the same from all hazards, in, upon, and over that portion of the Street proposed
to be vacated and described hereinabove. All proceedings for the vacation of said
Street are taken and shall be subject to the reservation of said described easement.
SECTION 3. The City Clerk shall certify to the adoption of this Resolution
and cause a certified copy thereof, attested by the City Clerk under the Seal of
the City of Downey, to be recorded in the Office of the County Recorder of the
County of Los Angeles.
