A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING VACATION OF A PORTION OF THE ALLEY LYING SOUTHERLY
AND PARALLEL WITH TELEGRAPH ROAD BETWEEN LAKEWOOD BOULEVARD
AND LINDELL AVENUE
WHEREAS, by Resolution No. 2017, the City Council of the City of Downey
adopted the 26th day of December, 1967, declared its intention to vacate that
portion of the Alley lying southerly and parallel with Telegraph Road between
Lakewood Boulevard and Lindell Avenue, as shown on Map on file in the Office of
the City Clerk, and setting a hearing thereon for the hour of 7:30 P.M. on
January 8, 1968; and
WHEREAS, the public hearing on said intended vacation duly was held and a
full and fair hearing was held thereon.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. The City Council of the City of Downey finds from all the
evidence submitted at said hearing that that portion of the Alley lying southerly
and parallel with Telegraph Road between Lakewood Boulevard and Lindell Avenue
as shown on Map on file in the Office of the City Clerk hereinafter described is
unnecessary for present or prospective use, and it is hereby ordered vacated.
Said area is described as follows:
That portion of Tract 9389 in the City of Downey, County of
Los Angeles, State of California, within a strip of land 20 feet
wide marked "Alley" and dedicated for public use on Map recorded
in Book 149, Pages 64 & 65 of Maps in the Office of the County
Recorder of said County, bounded on the Northwest by the north-
easterly prolongation of the northwesterly line of Lot 56 in said
Tract and bounded on the Southeast by a line parallel with and
distant northwesterly 30.00 feet, when measured at right angles,
from the Centerline of Lindell Avenue, formerly Lexington and
Gallatin Road, as shown on said Map.
SECTION 2. Pursuant to the authority of Sections 8330 and 8331 of the
Streets and Highways Code of the State of California, the City Council hereby
determines that the public convenience and necessity require the reservation of
a permanent easement and right at any time or from time to time to construct,
maintain, operate, replace, remove and renew sanitary sewers and appurtenant
structures including access and the right to protect same from all hazards in,
upon, and over the southwesterly 10 feet of that portion of the Alley proposed
to be vacated and described hereinabove. All proceedings for the vacation of
said Alley are taken and shall be subject to the reservation of said Easement.
SECTION 3. The City Clerk shall certify to the adoption of this resolution
and cause a certified copy thereof, attested by the City Clerk under the seal of
the City of Downey, to be recorded in the Office of the County Recorder of the
County of Los Angeles.
