A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING ITS INTENTION TO VACATE A PORTION OF THE ALLEY
LYING SOUTHERLY AND PARALLEL WITH TELEGRAPH ROAD BETWEEN
LAKEWOOD BOULEVARD AND LINDELL AVENUE
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Downey, upon recommendation
of the Planning Commission, hereby declares its intention to vacate a portion
of the Alley lying southerly of and parallel with Telegraph Road, between
Lakewood Boulevard and Lindell Avenue, as shown on Map on file in the office
of the City Clerk, to which reference is made for further particulars, this
area to be vacated being described as that portion of Tract 9389 in the City
of Downey, County of Los Angeles, State of California, within a strip of land
20 feet wide marked Alley and dedicated for public use on Map recorded in
Book 149, Pages 64 and 65 of Maps in the Office of the County Recorder of
said County, bounded on the northwest by the northeasterly prolongation of
the northwesterly line of Lot 56 in said Tract and bounded on the southeast
by a line parallel with and distant northwesterly 30.00 feet, when measured
at right angles, from the centerline of Lindell Avenue, formerly Lexington
and Gallatin Road, as shown on said Map.
SECTION 2. Pursuant to the authority of Section 8330 and 8331 of the
Streets and Highways Code of the State of California, the City Council hereby
determines that the public convenience and necessity require the reservation
of a permanent easement and right at any time or from time to time, to con-
struct, maintain, operate, replace, remove and renew sanitary sewers and
appurtenant structures including access and the right to protect same from all
hazards in, upon, and over the southwesterly 10 feet of that portion of the
alley proposed to be vacated and described hereinabove. All proceedings for
the vacation of said alley are taken and shall be subject to the reservation
of said easement.
SECTION 3. The hour of 7:30 P.M. on the 8th day of January, 1968, is here-
by fixed as the time, and the Council Chambers in the City Hall at 8 425 Second
Street, Downey, California, is hereby fixed as the place for hearing all persons
interested in objecting to the proposed vacation of said street.
SECTION 4. The City Clerk shall cause this resolution to be published in
the manner required by Section 8322 of the Streets and Highways Code of the
State of California.
SECTION 5. Notices of the proposed street vacation shall be posted in the
manner prescribed by said Section 8322.
SECTION 6. The City Clerk shall certify to the adoption of this resolution.
