A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING
AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND
NECESSITY REQUIRE THE ACQUISITION OF THE 3 /28THS INTEREST IN
AND TO THE WATER WELL AND PUMPING PLANT WITHIN CITY OWNED
PROPERTY LYING ON THE SOUTH SIDE OF STEWART AND GRAY ROAD,
EASTERLY OF THE WEST CITY LIMITS
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. That the City Council hereby finds, determines and declares that
the public interest and necessity require the acquisition of the 3 /28ths interest
in and to the water well and pumping plant within City owned property, lying on
the South Side of Stewart and Gray Road, easterly of the West City Limits.
That the interest sought to be acquired will be most compatible to the
greatest public good and the least private injury.
SECTION 2. That the City Council finds, determines and declares that the public
interest, convenience and necessity require the acquisition of this interest in and
to the real property hereinafter described, and the City Council hereby declares it
is the intention of the City of Downey to acquire in its name the interest, in and
to said hereinafter described real property by Condemnation, in accordance with the
provisions of the Code of Civil Procedure and the Constitution of the State of
California, authorizing the exercise of the right of eminent domain.

SECTION 3. That said /real property, the acquisition of which is required by the
public interest, convenience and necessity for the purpose set forth in Sections 1
and 2 hereof, is described as follows:
An undivided 3 /28ths interest in and to the Water Well and Pumping Plant
in the Northeast Corner of the land hereinafter described as reserved in
Deed from Arthur Rathaus, recorded in Book 11860 Page 26, Official Records.
Said Well and Pumping Plant is located within that portion of the Rancho
Santa Gertrudes, in the City of Downey, County of Los Angeles, State of
California, described as follows:
Beginning at the most northerly corner of Helene Laventhal Property, as
per Map recorded in Book 12, Page 96 of Maps, in the Office of the County
Recorder, of said County; thence northwesterly parallel with the Centerline
of Stewart and Gray Road as shown on said Map, 892.76 feet, more or less,
to a 2 -inch pipe set in concrete on the Southwest line of said Road, said
pipe being southeasterly 154.59 feet, more or less, from the most easterly
corner of Block "A" of the property of T. A. House, as per Map recorded in
Book 11, Page 71 of Maps, in the Office of the County Recorder of said
County, said pipe being the most easterly corner of the land described in
Certificate No. BG -21094 on file in the Office of the Registrar of Title
of said County; thence southwesterly in a direct line 613.24 feet; more or
less, to a 2 -inch pipe in concrete on the Northeast line of the land of
Los Angeles County Farm (formerly land of Beboma), distant southeasterly
along said line and prolongation thereof, 121.16 feet from the intersection
thereof with the Southeast line of said Property of T. A. House; thence
southeasterly along said Northeast line of land of Los Angeles County Farm
893.41 feet, more or less, to the most westerly line of said Helene Laventhal
property; thence northeasterly along the Northwest line of said property,
--- 610.80 feet, more or less, to the point of beginning.
SECTION 4. That the City Attorney of the City of Downey, and Burke, Williams
and Sorensen, hereby are authorized, empowered, and directed to prepare, institute
and prosecute in the name of the City of Downey, such proceedings in the proper
court having jurisdiction thereof as are necessary for the condemnation of said
interest in said real property described in Section3 of this Resolution.
SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
APPROVED AND ADOPTED this 26th day of September, 1967.

September, 1967, by the following vote:
