HomeMy WebLinkAboutResolution No. 1971 RESOLUTION NO. /9 7/ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING VACATION OF A PORTION OF THE SERVICE ROAD LOCATED ALONG THE SOUTHERLY SIDE OF TELEGRAPH ROAD EASTERLY OF PASSONS BOULEVARD WHEREAS, by Resolution No. 1967, the City Council of the City of Downey adopted the llth day of September, 1967, declared its intention to vacate that --- portion of the Service Road located along the southerly side of Telegraph Road at the southeasterly corner of Passons Boulevard, as shown on Map on file in the Office of the City Clerk, and setting a hearing thereon for the hour of 8:00 A.M. on the 26th day of September, 1967; and WHEREAS, the public hearing on said intended vacation duly was held and a full and fair hearing was held thereon. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Downey finds from all the evidence submitted at said hearing, that that portion of the Service Road located along the southerly side of Telegraph Road at the southeasterly corner of Passons Boulevard as shown on Map on file in the Office of the City Clerk hereinafter described is unnecessary for present or prospective use, and it is hereby ordered vacated, Said area so vacated is described as follows: That portion of Telegraph Road, formerly Anaheim Telegraph Road in the City of Downey, County of Los Angeles, State of California, dedicated for public use on Map of Tract No. 14395 recorded in Book 364, Pages 21 through 24 of Maps in the Office of the County Recorder of said. County, described as follows: Beginning at the easterly corner of Lot 1 in said Tract No. 14395; thence North 50 ° 15'00" West along the northeasterly line of said Lot, 42.50 ft. to the beginning of a tangent curve concave southerly and having a radius of 15.00 feet as shown on said Map; thence westerly thereon 23.56 ft. to a point of cusp with the northeasterly prolongation of the southeasterly line of Passons Boulevard, 60 ft. wide, as shown on said Map; thence North 39 ° 45'00" East along said prolongation 42.00 ft. to the beginning of a tangent curve concave southerly and having a radius of 15.00 ft. which is also tangent to a line parallel with and distant southwesterly 50.00 ft. measured at right angles from the Centerline of Telegraph Road as shown on s said Map; thence easterly along said curve 23.56 ft. to said parallel line; thence South 50 ° 15'00" East thereon 42.50 ft. to the prolongation of the southeaterly line of said Lot 1; thence South 39 ° 45'00 11 West thereon 42.00 ft. to the point of beginning. SECTION 2. Pursuant to the authority of Sections 8330 and 8331 of the Streets and Highways Code of the State of California, the City Council hereby determines that the public convenience and necessity require the reservation of a permanent easement and right at any time, or from time to time, to maintain, i °n�' s�, operate, ep b , r v t e 'e a h i t s B anc fo l h e eran ° sport e at ° on a n - r i d Far? of water, electrical energy and incidental purposes, including access and right to keep the property free from flammable materials and weed growth, and otherwise protect the same from all hazards, in, upon and over that portion of the area proposed to be vacated and described hereinabove, except the southeasterly 33 feet thereof. All proceedings for the vacation of said area are taken and shall be subject to the reservations of said described easement. SECTION 3. The City Clerk shall certify to the adoption of this resolution and cause a certified copy thereof, attested by the City Clerk under the seal of the City of Downey, to be recorded in the Office of the County Recorder of the County of Los Angeles.
