HomeMy WebLinkAboutResolution No. 1967 RESOLUTION NO . ? /Z,7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO VACATE A PORTION OF THE SERVICE ROAD LOCATED ALONG THE SOUTHERLY SIDE OF TELEGRAPH ROAD, AT THE SOUTHEASTERLY CORNER OF PASSONS BOULEVARD THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Downey, upon recommendation of the Planning Commission, hereby declares its intention to vacate a portion of the service road located along the southerly side of Telegraph Road, at the southeasterly corner of Passons Boulevard, as shown on Map on file in the office of the City Clerk to which reference is made for further particulars. The area to be vacated being described as: That portion of Telegraph Road, formerly Anaheim Telegraph Road in the City of Downey, County of Los Angeles, State of California, dedicated for public use on Map of Tract 14395 recorded in Book 364, pages 21 through 24 of Maps in the Office of the County Recorder of said County described as follows: Beginning at the easterly corner of Lot 1 in said Tract 14395; thence North 50 ° 15'00" West along the northeasterly line of said Lot 42.50 feet to the beginning of a tangent curve concave southerly and having a radius of 15.00 feet as shown on said Map; thence westerly thereon 23.56 feet to a point of cusp with the northeasterly prolongation of the southeasterly line of Passons Boulevard 60 feet wide as shown on said Map; thence North 39 ° 45'00" East along said prolongation 42.00 feet to the beginning of a tangent curve concave southerly and having a radius of 15.00 feet which is also tangent to a line parallel with and distant southwesterly 50.00 feet, measured at right angles, from the centerline of Telegraph Road as shown on said Map; thence easterly along said curve 23.56 feet to said parallel line; thence South 50 ° 15'00" East ther a n 42.50 feet to the pro- longation of the southeasterly line of said Lot 1; thence South 39 ° 45'00" West thereon 42.00 feet to the point of beginning. SECTION 2. Pursuant to the authority of Sections 8330 and 8331 of the Streets and Highways Code of the State of California, the City Council hereby determines that the public convenience and necessity require the reservation of a permanent easement and right at any time, or from time to time, to maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures and fixtures for the operation of drainage facilities, gas pipe lines, telephone and telegraph lines, and for the transportation and distribution of water, electrical energy and incidental purposes, including access and the right to keep the property free from all hazards, in, upon, and over that portion of the area proposed to be vacated and described hereinabove, except the southeasterly 33 feet thereof. All proceedings for the vacation of said area are taken and shall be subject to the reservation of said described easement. SECTION 3, The hour of 8:00 A.M. on the 26th of September, 1967, is hereby fixed as the time, and the Council Chambers in the City Hall at 8425 Second Street, Downey, California, hereby fixed as the place for hearing all persons interested in objecting to the proposed vacation of said area. SECTION 4. The City Clerk shall cause this Resolution to be published in the manner required by Section 8322 of the Streets and Highways Code of the State of California. SECTION 5. Notices of the proposed Service Road Vacation shall be posted in the manner prescribed by said Section 8322. SECTION 6. The City Clerk shall certify to the adoption of this Resolution.
