HomeMy WebLinkAboutResolution No. 1937 2908 RESOLUTION NO. 1'73) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO VACATE A PORTION OF LEXINGTON ROAD AND BROOKSHIRE AVENUE, AT THE NORTHWEST CORNER OF THE INTERSECTION OF LEXINGTON ROAD AND BROOKSHIRE AVENUE THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Downey upon recommendation of the Planning Commission hereby declares its intention to vacate that portion of Lexington Road and Brookshire Avenue located at the northwesterly corner of the intersection of said Road and Avenue as shown on map on file in the office of the City Clerk to which reference is made for further particulars. The area to be vacated being described as: That portion of the Rancho Santa Gertrudes in the City of Downey, County of Los Angeles, State of California, described as follows: Commencing at an angle point in the centerline of Lexington and Gallatin Road as described in deed recorded May 19, 1941 as Document No. 458 in the office of the County Recorder of said county; thence North 58 West along said centerline of Lexington and Gallatin Road, now Lexington Road, 115.05 feet; thence North 31 East 30.00 feet to a line parallel with and distant 30.00 feet northeasterly, measured at right angles, from said centerline, and the true point of beginning; thence South 58 ° 48'50" East along said parallel line 65.05 feet to the beginning of a tangent curve concave northerly and having a radius of 15.00 feet; thence easterly thereon 23.57 feet to a point of tangency with a line parallel with and distant 35.00 feet northwesterly, measured at right angles from said centerline of Lexington and Gallatin Road, now Brookshire Avenue, as shown on Map of Tract No. 9996 recorded in Book 140, Page 1 of Maps in said Recorder's office; thence North 31 ° 09'45" East along said parallel line 56.06 feet to a point in a nontangent curve concave northerly and having a radius of 125.00 feet, being the northerly line of said Lexington and Gallatin Road, as shown on said map, a radial line of said curve through this point bears South 35 ° 45'49" East; thence westerly along said curve 110.59 feet to the true point of beginning, a radial line through this point bears South 14 West. SECTION 2. Pursuant to the authority of Sections 8330 and 8331 of the Streets and Highways Code of the State of California, the City Council hereby determines that the public convenience and necessity require the reservation of a permanent easement and right at any time, or from time to time, to maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures and fixtures for the operation of gas pipe lines, petroleum transmission lines, telephone and telegraph lines, and for the transportation and distribution of water, electrical energy and incidental purposes, including access and the right to keep the property free from flammable materials and weed growth, and otherwise protect the same from all hazards, in, upon, and over that portion of the street proposed to be vacated and described hereinabove. All proceedings for the vacation of said street are taken and shall be subject to the reservation of said described easement. SECTION 3. The hour of 7:30 P.M. on the 10th day of July, 1967, is hereby fixed as the time, and the Council Chamber in the City Hall at 8425 Second Street, Downey, California, hereby fixed as the place for hearing all persons interested in objecting to the proposed vacation of said street. SECTION 4. The City Clerk shall cause this resolution to be published in the manner required by Section 8322 of the Streets and Highways Code of the State of California. SECTION 5. Notices of the proposed street vacation shall be posted in the manner prescribed by said Section 8322. SECTION 6. The City Clerk shall certify to -toe adoption of this resolution.
