A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY MAKING APPLICATION FOR DETACHMENT OF A PORTION OF THE SOUTHEAST RECREATION AND PARK DISTRICT. WHEREAS, the City Council of the City of Downey desires to initiate proceedings for the detachment from the Southeast Recreation and Park District that portion of said District located within the boundaries of the City of Downey. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. Application and a proposal hereby are made to the Local Agency Formation Commission of the County of Los Angeles for change of organization as follows: a) This proposal is made pursuant to the District Reorganization Act of 1965 commencing c ng with Section 56000 of the Government Code. --, b) The nature of the proposed change of organization and the name of all the districts and cities for which any such change of organization is pro- posed are as follows: The detachment from the Southeast Recre- ation and Park District of that portion of said District within the boundaries of the City of Downey. A portion of the Southeast Recreation and Park District is located within the boundaries of the City of Downey. The City of Downey already has under- taken the development of a park program and recreation service and by reason of the dissolution of the Downey Recreation and Park District the City has undertaken the functions that previously were per - formed by said District within that portion of the City of Downey covered by said Downey Recreation and Park District. 2. The functions performed by and the ser- vices provided by the District can be performed and provided by the City of Downey equally as well as by the District and at a lesser cost to the inhabitants of the District. At present the property owners within said Southeast Recreation and Park District within the City of Downey pay the same city tax as other property owners within the City and in addition thereto pay the tax imposed by the Southeast Recreation and Park District. - 2 2903 3. A detachment of said portion of said District will remove a duplication of governmental functions and a duplication of tax upon the property owners within said portion of said Southeast Recre- ation and Park District because the pro- perty owners and residents therein will receive the same service from the City in relation to recreational ro rams and p g park facilities as are received by all other residents of the City. The removal of the duplication and overlapping of services will create a greater efficiency of operation and saving to the tax payers. 4. The City of Downey is a Charter City with a population in excess of 93,000 and an assessed valuation of over $180 with a strong feeling of community identity. The City has undertaken programs to remove an overlying water district and as afore- said remove one overlying Recreation and Park District and it has been the desire and the purpose of the City and its citizens that all necessary functions for its citizens in relation to public facilities services, recreation, cultural services and the like be provided by the _. City. A more cohesive, consistent recre- ation program identified with the particular needs of the citizens of Downey and in par - ticular with the needs of the citizens of Downey located at present within the South - east Recreation and Park District and de- velopment of park and recreation areas in that portion of the City consistent with the needs of its citizens can be developed without extra cost to the citizens if the detachment is allowed. 5. The financial resources of the City are sufficient to provide the necessary services to the area and, in fact, the City by draw- ing upon the diverse sources of income available to the City, the taxing procedures and methods under its Charter and the economy of providing administrative services will be able to provide increased stability and accel- erative program of the recreation and park function throughout the City and throughout the area in question without additional cost to the tax payers affected. 6. The District was formed at the time when services were not available to be performed by the City the holdover district does not include, obviously, all property in the City and consequently many properties in the City are not contributing to the support of the District. Inequities in district boundaries - 3 - 2804 and services will be eliminated when the detachment is allowed and all park and recreation functions within the City become the sole responsibility of the City of Downey. 7. The City of Downey has established its own Park and Recreation Commission of five members each appointed from one of the councilmanic districts to provide city wide representation. The City of Downey has employed a Superintendent of Parks and Recreation who with the Park and Recreation Commission is in the pro- cess of planning and implementing the development of the entire park program within the city. SECTION 2. The City Clerk of the City of Downey hereby is authorized and directed to certify to the adoption of this Resolution and to file a certified copy thereof with the Executive Officer of the Local Agency Formation Commission of the County of Los Angeles.
