HomeMy WebLinkAboutResolution No. 1893 2852 RESOLUTION NO. 1893 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY OPPOSING ASSEMBLY BILL 363 RELATING TO COMPULSORY ARBITRATION WHEREAS, Assembly Bill No. 363, as proposed, provides in effect that if the public agency and fire fighters cannot resolve any dispute by good faith negotia- tions that either party may submit the matter to arbitration and the determination of the Board of Arbitration would be final and binding; and WHEREAS, the effect of such legislation is to delegate to nonelected, non- responsive persons the right to decide matters relating to wages, hours and fringe benefits of fire fighters; and WHEREAS, any such decision relating to wages, powers and benefits of fire fighters could have a direct affect upon the operating budget of the public agency and could compel either an increase in tax rates or a reduction in other essential services in the event the tax rate then was at its maximum; and WHEREAS, it effectively deprives the voters of the City of the right to have its representatives make decisions on matters concerning the City; and WHEREAS, it is in derogation of the principle of the electors of a public agency having the right to decide by their votes matters affecting the public agency; and WHEREAS, it would permit a small minority to override the majority votes of the electors of a public agency and have a direct affect upon the tax burden which would be imposed upon the electors even through contrary to their expressed intention at the polls. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the adoption of Assembly Bill 363 would be contrary to the basic principle of "one man one vote" guaranteed by the Constitution and would effectively deprive public entities of the right to determine matters affecting employment of personnel, compensation of personnel and the operating budgets and resultant tax rates which would be applicable within the public agency. SECTION 2. That it respectfully urges the Assembly to defeat this bill as the same is contrary to the best interests of all local government. SECTION 3.
