A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY PURSUANT TO THE STREET LIGHTING ACT OF 1919 ORDERING ANNEXATION OF CERTAIN AREAS TO THE DOWNEY CITY LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON THE STREETS AND PUBLIC PLACES WITHIN THOSE AREAS UNTIL JANUARY 31, 1983 (ANNEXATION D) WHEREAS, the City Council of the City of Downey, on November 22, 1966, adopted Resolution No. 1834 declaring its intention to order those certain improvements aforesaid; and WHEREAS, on November 22, 1966, the City Council, by Resolution No. 1834 appointed the hour of 8:00 A.M., December 27, 1966, in the Council Chambers of the City Hall of the City of Downey as the time and place for hearing pro - tests in relation to said improvement; and WHEREAS, on December 27, 1966, at the time and place as specified, a public hearing duly was held in relation to said improvement, all in accordance with said Resolution No. 1834, notice having been duly given of said hearing in the manner required by law; and WHEREAS, at said hearing the City Council did hear and pass upon all written and oral protests made in reference to said improvement; and WHEREAS, on. November 22, 1966, the Preliminary Report of the Director of Public Works estimated the cost of said improvements for the first year to be $2,806.16, and further described in Section 4 below. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The proposed improvement consists of the furnishing of energy and maintenance for street lighting in accordance with the Preliminary Report of the Director of Public Works, dated November 22, 1966, on file in the office of the City Clerk. SECTION 2. The proposed improvement shall be for a period of time beginning July 1, 1967, and ending January 31, 1983. SECTION 3. The boundaries of Annexation D of the Doe 9 City Lighting District are described on Street Lighting Plans Nos. SL -56,an SL -61 throw. 65 and also by legal descriptions in words, attached hereto and by this reference incorporated herein and made a part hereof, the same as though set forth in full. SECTION 4. The entire estimated cost of said improvements for the first year shall be borne by the District, with the proportion paid by each zone de- scribed as follows: ZONE I $2,333.20 ZONE II 272.96 TOTAL: $2,606.16 SECTION 5. It hereby is ordered that said proposed improvement as described and set forth in Resolution. Number 1834 and the Preliminary Report of the Director of Public Works submitted pursuant to Resolution Number 1833 be made in the manner prescribed by law. SECTION 6. That the City Council hereby finds that the Southern California Edison Company is the only contractor practically capable of serving the street lighting systems to be annexed in the manner provided for and as described herein and the Southern California Edison Company is subject to the jurisdiction of the Public Utilities Commission of the State of California. It, thereby, is ordered that the lighting systems to be annexed be serviced until January 31, 1983, in accordance with the provisions of Resolution Number 1086 for the Downey City Lighting District on file in the office of the City Clerk. SECTION 7. The City Clerk shall certify to the adoption of this resolution and cause a certified copy thereof to be filed along with Plans Numbers SL -56 and 2787 SL- 59 SL -65, including appropriate legal descriptions, in words, describing and showing the areas to be annexed, with the County Assessor, the Clerk of the Board of Supervisors and the State Board of Equalization and further shall cause a copy of this Resolution to be published once in the "Southeast News ".
