HomeMy WebLinkAboutResolution No. 1838 2773 RESOLUTION NO. %,i , 3c:F A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING THAT THE PUBLIC INTEREST, CONVENIENCE AND NEC- ESSITY REQUIRE THE ACQUISITION OF CERTAIN PROPERTY FOR STREET PURPOSES ON THE SOUTH SIDE OF FIRESTONE BOULEVARD SOUTH TO EXISTING PATTON ROAD THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council hereby finds, determines and declares that the public interest and necessity require the acquisition of rights -of -way in, over and under the hereinafter described real property for public street purposes and all uses appurtenant thereto. That the location of the land for said street has been planned and located in the manner which will be most compatible to the greatest public good and the least private injury. SECTION 2. That the City Council finds, determines and declares that, in order to acquire said rights of way in, on, over and under said land for said street purposes and use the same for said purposes, the public interest, con- venience and necessity require the acquisition of the rights -of -way by the City of Downey, in, on, over and under that certain real property hereinafter described, and the City Council hereby declares it is the intention of the City of Downey to acquire in its name said rights -of -way in, on, over and under said hereinafter described real property by condemnation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California authorizing the exercise of the right of eminent domain. SECTION 3. That said real property, the acquisition of which is required by the public interest, convenience and necessity for the purpose set forth in Sections 1 and 2 hereof, is described as follows: PARCEL 1 - A. That portion of Lot 1 of Tract 2707 in the City of Downey, County of Los Angeles, State of California, as per Map recorded in Book 33, Page 75 of Maps, in the Office of the County Recorder of said County, lying within a strip of land 60.00 feet wide, the center- line of said strip being the northeasterly prolongation of the northwesterly line of Lot P of the Rancho Santa Gertrudes oer Map recorded in Book 32, Page 18 of Miscellaneous Records in said Recorders Office. Except that portion of said Lot 1 described in deed recorded June 2, 1965, as Document 1991 in Book D2925, Page 515 in said Recorders Office. Also except that portion of said Lot 1 lying northeasterly of the southwesterly line of Firestone Boulevard as conveyed to the State of California by deed recorded in Book 13885, Page 140 of Official Records in said Recorders Office. To be known as Patton Road. B. That portion of said Lot 1, in. Tract 2707 described as follows: Beginning at the intersection of the southeasterly line of the above described parcel 1 -A with the southwesterly line of Firestone Boule- vard as described in deed recorded in Book 13885, Page 140 Official Records in said Recorders Office; thence southeasterly along said southwesterly line 14.43 feet to a point of cusp with a tangent curve concave southerly and having a radius of 15.00 feet; thence westerly thereon 23.01 feet to a point of cusp with said southeast- erly line; thence northeasterly thereon 14.43 feet to the point of beginning. To be known as Patton Road. Fey 2?7 PARCEL 2 - A. That portion of Block 6 of the Tract of the Downey Land Association in the Cit o City of Downey, County of Los Angeles, State of California, per Map recorded in Book 2, Page 434 of Miscellaneous Records in the Office of the County Recorder of said County, together with that portion of Lot 1 of Tract 2707 in said City, County and State, per Map recorded in Book 33, Page 75 of Maps in said Recorders Office lying within a strip of land 60.00 feet wide, the centerline of said strip being the northeasterly prolongation of the northwesterly line of Lot P of the Rancho Santa Gertrudes per Map recorded in Book 32, Page 18 of Miscellaneous Records in said Recorders Office. Except that portion of said land lying northeasterly of the southwesterly line of Firestone Boulevard as conveyed to the State of California by deed recorded in Book 13885, Page 140 Official Records in said Recorders Office. Also except therefrom that portion thereof, described as follows: Beginning at the most easterly corner of said Lot 1; thence South 31 ° 31'10" West along the southeasterly line of said Lot 1, a distance of 36.10 feet to the southwesterly line of Firestone Boulevard, 100 feet wide, as shown on County Surveyor's Map B -1115 of said County, and as described in Deed to State of California, recorded in Book 13885, Page 140, Official Records, to the true point of beginning; thence continuing along the said , southeasterly line, 125.00 feet; thence North 60 ° 22'06" West parallel with the said southwesterly line of Firestone Boulevard, 90.00 feet; thence North 31 ° 31'10" East, parallel with the said southeasterly line of Lot 1, a distance of 125.00 feet to the said southwesterly line of Firestone Boulevard; thence South 60 ° 22'06" East along said southwesterly line of Firestone Boule- — yard, 90.00 feet to the true point of beginning. To be known as Patton Road. B. That portion of said Block 6 of the Tract of the Downey Land Association, described as follows: Beginning at the intersection of the northwesterly line of the above described Parcel 1 with the southwesterly line of Firestone Boulevard as described in Deed recorded in Book 13885, Page 140 of Official Records in said County Recorders Office; thence south- westerly along said northwesterly line 15.60 feet to a point of cusp with a tangent curve concave westerly and having a radius of 15.00 feet; thence northerly along said curve 24.15 feet to a point of cusp with said southwesterly line; thence southeasterly thereon 15.60 feet to the point of beginning. To be known as Patton Road. SECTION 4. That the City Attorney of the City of Downey, and Burke, Williams and Sorensen, hereby are authorized, empowered and directed to prepare, institute and prosecute in the name of the City of Downey, such proceedings in the proper court having jurisdiction thereof as are necessary for the condemna- tion of said rights -of -way in said real property described in Section 3 of this Resolution. Said attorneys hereby are authorized and empowered to take such procedure as may be necessary to secure an order of immediate possession for the use of and occupancy of said property. 2780 SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
