HomeMy WebLinkAboutResolution No. 1832 2769 RESOLUTION NO. 1832 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY URGING LEGISLATION CHANGING THE REQUIREMENTS FOR THE PUBLISHING OF PREVAILING WAGE SCALES. WHEREAS, by the provisions of 1770 et seq. of the Labor Code of the State of California cities are required to adopt a resolution determining the prevailing rate of per diem wages for public works projects; and WHEREAS, it is required by Section 1773 of the Labor Code that the public body calling for contract for public work shall specify in the call for bids for the contract and in the contract itself what the general prevailing rate of per diem wages shall be; and WHEREAS, the Attorney General of the State of California has determined that a mere reference in the call for bids to the fact that the City Council has determined the prevailing wage scale and has a copy of the resolution or ordinance so determin- ing on file is not sufficient and that the actual wage scale must be published in the call for bids; and WHEREAS, the specification of wages in the call for bids serves no real purpose; and WHEREAS, the requirement that such wages be published in each call for bids imposes a heavy financial burden upon each city in connection with its public works projects at a time when all cities are seeking to find ways and means of easing the tax burden on their respective property owners and residents by reduc- ing the cost of government; and WHEREAS, in the City of Downey the requirement of such publication increases the legal advertising costs of the City by approximately 400%. 2770 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1: That the League of California Cities propose and support legislation which in substance will eliminate the requirement that the prevailing wage scale as determined by each city be published in each call for bids and only require publication of such a determination each time a city adopts a resolution deter- mining the prevailing wage scale, provided that such prevailing wage scale be published at least once each fiscal year. SECTION 2: That the League of California Cities request each city to make an analysis of the additional cost to it of the present requirement of publication of the prevailing wage scale and submit such information to the League of California Cities, or other appropriate agency or body, so that the members of the legislature may have some information as to the burden of the unjustified cost imposed upon cities by the above referred to sections of the Labor Code. SECTION 3: That a copy of this resolution be forwarded to the League of California Cities and to such other agencies, organizations, and associations as may be deemed advisable. SECTION 4: The City Clerk shall certify to the adoption of this resolution.
