RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING
THE VACATION OF A PORTION OF LINDELL AVENUE BETWEEN LAKEWOOD
BOULEVARD AND TELEGRAPH ROAD
WHEREAS, by Resolution No. 1808, the City Council of the City of Downey
adopted October 25, 1966, declared its intention to vacate that portion of
Lindell Avenue, between Lakewood Boulevard and Telegraph Road, as shown on
Exhibit "A" on file in the office of the City Clerk, to which reference is made
for further particulars; and.
WHEREAS, the public hearing on said intended vacation was duly held, and a
full and fair hearing was had thereon;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Downey finds, from all evidence
submitted at said Hearing, that this area is unnecessary and a liability upon the
City and it is hereby ordered vacated. Said area to be vacated is described as
follows:
That portion of Lindell Avenue, formerly Lexington and Gallatin Road, in
the City of Downey, County of Los Angeles, State of California, dedicated
for public use on Map of Tract No. 9389, recorded in Book 149, Pages 64
and 65 of Maps in the Office of the County Recorder of said County, described
as follows: Commencing at a point in the southeasterly line of Lot 62 in
said Tract distant South 53 ° 24'45" West thereon 22.37 feet from the easterly
corner of said Lot; thence northwesterly at right angles to said southeasterly
line 5.00 feet to a line parallel with and distant 30.00 feet northwesterly
from the Centerline of said Lindell Avenue, formerly Lexington and Gallatin
Road as shown on said Map, said Point being the beginning of a curve tangent
to said Parallel line concave southeasterly and having a radius of 430 feet;
thence southwesterly along said curve to the northwesterly line of said
Lindell Avenue and the true point of beginning for the description; thence
continuing southwesterly along said curve to said. Centerline; thence South
53 ° 24'45" West thereon to the southwesterly prolongation of the northwesterly
line of Lot 53 in said Tract; thence North 23 ° 45'00" East thereon to a point
of cusp with a curve in the southerly boundary of said Lot 53 concave north-
easterly and having a radius of 25 feet as shown on said Map; thence south-
easterly thereon to said northwesterly line of Lexington Road; thence North
53 ° 24'45" East thereon to the point of beginning.
SECTION 2. Pursuant to the authority of Sections 8330 and 8331 of the Streets
and Highways Code of the State of California, the City Council hereby determines
that the Public convenience, and necessity require the reservations of a permanent
easement and right at any time, or from time to time, to construct, maintain,
operate, replace, remove and renew storm drains, sanitary sewers, and appurtenant
structures in, upon, over and across the street or part thereof, proposed to be
vacated, and maintain, operate, replace, remove, renew and enlarge lines of pipe,
conduits, cables, wires, poles and other convenient structures and fixtures for the
operation of gas pipe lines, telegraph and telephone lines, and for the transporta-
tion and distribution of electrical energy, water and incidental purposes, including
access and the right to keep the property free from flammable materials and weed
growth, and otherwise protect the same from all hazards in, upon and over that
portion of the street proposed to be vacated and described as follows:
A strip of land ten feet (10') wide, the southeasterly line of said. Strip
being the Centerline of said Lindell Avenue, formerly Lexington and Gallatin
Road as shown on said Map of Tract No. 9389.
SECTION 3, The City Clerk shall certify to the adoption of this resolution and
cause a certified copy thereof, attested by the City Clerk, under the Seal of the
City of Downey to be recorded in the office of the County Recorder of the County of
Los Angeles.
